Sacking someone convicted of a sexual offence

If someone is charged AND convicted of a sex offence (!!!!!philia) can the employer sack him?

I've looked online but can't find anything about someone who's been charged with this type of offence - there's things about hooliganism and stealing but not this.

If the employee doesn't get a custodial and doesn't want to lose their job - can you actually sack them fairly for this type of thing?

    I think it would depend upon the job and where he was working, obviously if he/she was working alongside kids there's going to be risks. But a peado that comes out of jail isn't barred for life over getting another job.

    You tend to have something in your contract or work's term and conditions that covers things like this.

    He's been suspended as far as we know but everyone's saying they don't want to work with him if he returns. None of our jobs require to have a criminal records check and we don't work with children or vulnerable people.

    Even if he is found innocent?
    Don't trust a forum for advice. Get proper paid advice. Any advice given should always be checked

    He's been charged but not custodial he's got community service.
  • I think it would be constructive dismissal if he was sacked for an offence that has no impact on his job. He might be asked to move departments or something. A lot of people convicted of these types of offences find they need to seek work elsewhere anyway because of the stigma from their colleagues.

    One chap at a company where I used to work downloaded child !!!!!!. He didn't come back. Most of the staff said they wouldn't work with him. I don't know what rules he broke but it may have been bringing the company into ill repute as his employers were named in the paper I think. (And employers advertised a lot in that local paper).

    It's a criminal conviction, and the person involved has signed the Sex Offenders' register? They have brought their employer into disrepute.
