I recently went to my doctor with an anomaly on my tongue he advised me to see my dentist asap, I got an urgent appt and dentist referred me to outpatients. I ticked the JSA ir box as I'd been on JSA for more than 6 months in total with a break in the middle. Later that day when I signed I asked my work coach and she advised me that I was still on C so I intended to rectify the error. But I received a penalty notice rather quickly, I emailed them back and they basically said "tough", I have called them and they told me to get a letter from my GP to state I was stressed and wasn't fully aware of what I was signing. Really? So one part of the NHS wants me to waste a valuable gp appointment because they don't believe me but my doctor will. And a letter from my gp will suffice. Absolutely ridiculous.
And who's fault is this situation? Lets be honest here....

If you were not stressed then please do not ask your doctor to lie for you. Unless you have an underlying mental health condition it's unlikely that will wash anyway, stress may have caused your initial mistake but didn't stop you rectifying it later.

How quickly is "rather quickly", surely you would have returned to the dentist straight after your JCP appt?

    Craig 1968,

You should Also ask DWP JSA what your screens show your JSA IB amount as...

If you claimed JSA IB, they have awarded you JSA Conts, but you will still have a JSA IB amount that you need to know what it is.

If you claimed JSA Conts ONLY then you claimed the wrong benefit.

You just want to know what the screen says your JSA Ib amount is...this does not qualify you for free health costs...so you should then fill in a HC1 and back date it to the date of your dentist appointment or further if you want... with a letter explaining why you did not do an HC1 earlier. And tell them what your JSA IB & JSA Conts amount is on your claim...

I received a NHS Penalty charge notice this morning for three prescriptions (+ £100 fine) for items in July, saying I had ticked the pre-payment certificate box - which I did as the card in my purse runs April to March! I also always hand over the pre-payment card to the chemist.

Emailed them the details, should get an reply soon
  • Wrong, very very wrong to penalise people who worked and contributed to give to those who never did.

Frankly contribution based should be higher all together and relative to contributions having been made (irrespective of any savings - if any exist) when the other should be just basic amount.

As it is - working people falling on hard times are always worse off then those who never bothered to work.

100% spot on. These penalty charges are akin to going over your parking ticket by a minute. No wonder its called NHS Business Authority... its a nice little earning for them cashing in on peoples honest and genuine mistakes. And the charge is disproportionate.
  • To put it plain and simple - The NHS last year made 1/4 million pounds having medical charges pushed on to people : this unfair stealth tax has increased to over 1 million pounds this year!

When people wise up that this process is not a mistake and it is a deliberate attempt to fund the NHS on the backs of the poor, then all concerned will be more careful. The problem is POOR people are not warned before falling for this practice!

Do you really think doctors and dentists surgeries dont know whats happening? of course they do, just like the forms say entitlement exists for Contribution based benefits but then in small print "as long as there is a income related component"

Complain to your MP or things will continue and the public taxed again and again, and penalties charged again and again.
  • Are you for real? Have you tried confronting NHS BECS regards fraudulant penalty charges? If not then I suggest your opinions should be less pointed. Firstly, once you provide evidence that the medical establishment was at fault they then require further evidences. Secondly once you provide further evidences they tell you your evidences are insufficient, thirdly, once you request they send your case to appeal, they refuse point blank and delay: However, this delay in sending to appeal gives them every opportunity to send reminders for payment daily. Once you contact your MP they might : and I mean might decide it best to follow process but with that comes daily reminders to pay the charge. The only thing that stops them in thier tracks is the threat of legal action due to breach of article 6 of the European Commission on Human rights indicating that they had breached the mental health act of 2005

    YES they are absolute criminals.

Im helping my mate to deal with these bunch and they said two things that frankly astonished me.
My mate claims Carers Allowance for her severely disabled mum which is her only income. She uses it to pay for taxis to her mums house each day to provide care and companionship as there is no bus service. She explained that if she were to pay the fine she could not provide care for her mum which would mean a) she was breaching the conditions of her Carers Allowance and b) her mum wouldnt receive any care. She was told essentially to commit benefit fraud as the fine was more important! this is 100% true, I was sat next to her with the phone on loudspeaker) she has type 2 diet controlled diabetes and she was also told to tell her doctor to lie on the form so she could get an exemption card!
She gave me permission to speak and I soundly told them off saying that they were essentially telling her to commit fraud on two counts and that I would take this further as it wasnt acceptable. I also asked them to confirm that they thought it was appropriate that a vulnerable elderly person should be left all day without food in a wet pad in a wet bed because their charge was more important. Funnily enough they said no that isnt acceptable...
