Just to elaborate ... where a windscreen ticket is placed on a vehicle then a Notice to Keeper (postal notice) must not arrive earlier than day 29 or later than day 56 (after the parking event) for keeper liability to be claimed.
If the notice is earlier or later than these dates then the keeper has additional weight to claiming the NtK is non-compliant with legal requirements (POFA).
However, none of the IPC members NtKs meet the requirements of POFA ... and to think they may get assistance with their paperwork and charged for this too.0 -
Update: I have just recieved the NOTICE TO KEEPER/HIRER letter this morning. it is dated on the 21/05/15. Got the ticket on the 12/03/15. My calculations they are 20 days late.
Should I appeal this? or just ignore?0 -
No need to appeal just send a simple statement that they have not met he strict conditions laid down in POFA 2012 to pursue the registered keeper for unpaid parking charges incurred by the driver & that they should take up the matter with the driver who you decline to name.Update: I have just recieved the NOTICE TO KEEPER/HIRER letter this morning. it is dated on the 21/05/15. BTW I make it 19 days late in arriving but the date on the NTK is 13 days out of time so they cannot even claim delays in the post. The day of the parking 'crime' is Day 0 the day after is Day 1 & the NTK must arrived between Day 28 & Day 56 if a Notice To Driver was left on the car.0 -
Keep the appeal as simple as Nigel says - don't embellish it, except to state that you, as the RK, was not the driver at the time although you were a passenger in the car. As they are out of time, you decline to name the driver.
Unfortunately the PPC is an IPC member, so the IAS will nit care and say that they believe that the RK was driving. Hence the need to deny being the driver in the initial and follow up appeals.0 -

Thank you for your recent email.
Whilst we recognise your comments associated with the Protection of Freedoms Act 2012 (POFA), the Parking Charge Notice above was not issued as a POFA compliant Parking Charge Notice (PCN).
Parking companies only have to comply with the Protection of Freedoms Act 2012 if they want to enforce keeper liability. The keeper liability provision allows them to pursue the keeper for whatever charge the driver was liable for.
As such, our client has not met the timescales for keeper liability on this occasion, and therefore will revert to the default position which is to pursue the driver.
I can confirm that both ZZPS Limited and Globe Protection Ltd are members of an Accredited Trade Association; both associations have a Code of Practice and we are duty bound to comply with their guidelines and in particular, the Approved Operator Scheme (“AOS”) Code of Practice.
The AOS Code of Practice can be viewed on the British Parking Association’s website www.britishparking.co.uk
Our systems indicate that the correct procedures have been followed in accordance with the Code and therefore the Parking Charge Notice stands and the balance is now payable.

Just reply and tell them that's fine - so they must now go and pursue the driver; and that you are under no obligation to tell them who the driver was, but that they should not make any assumption that it was the registered keeper.

Reply was sent to them as per above.
I have recieved a letter today from ZZPS, chasing a blaance of now £160 which inlcludes late payment and debt recovery charges.
ZZPS is registered at the same address as PCN Admin Centre who are chasing ob behalf of Globe Protection Ltd.
whats the best way to tacle this now? do I? or just ignore?

Report them to Companies House and HMRC. Quote their entry on the Companies House website
Last accounts show then to be "dormant" and you are concerned they are trading but not accounting for this.

hi there i would like some advice on a parking charge notice i have received from globe protection limited. the notice was issued on 22/01/15 and i have not replied to any of the letters i have previously received from a company called zzps limited the charge has now reached £190 and i have a letter from wright hassell solicitors. i have not appealed this charge yet. any advice on this matter would be very much appreciated.0
