eBay Private Seller stating "No Returns"

As the listing said the item was for XXX I think it was perfectly reasonable to assume it was for all of the XXX range or, at least, the majority.
In this case the item only works with a few early models and is incompatible with the vast majority.
So, in my opinion, although I acknowledge some responsibility for not researching the matter in more detail, I feel the seller is at the very least equally at fault.
In fact, I'd be quite willing to agree a compromise with the seller but I'm not prepared to shoulder the whole loss, particularly if the rules of the eBay platform are likely to be on my side.
There is no compromise on eBay, the seller gets a defect and pays the outward postage.....you get your money back and are free to dink another seller.
Karma my friend, it will find you out. I hope your eBay ID isn't one we can find.0

Just so you know, it would be a hell of a lot easier if we knew what XXX was...0

 .
They presumably won't "get a defect" if they agree to and make a refund as no dispute would have been opened?
Given that the seller is at least 50% responsible for the problem how am I "dinking" them any more than they are "dinking" me if I do nothing?
I would be happy to pay the postage both ways providing they refund the item. In that way seller would be back in the position they were in before they sold the item and I would be about six quid out of pocket.0

Whatever you do, don't Google "XXX"!anotheruser wrote: »Just so you know, it would be a hell of a lot easier if we knew what XXX was...
For my tuppence on this. If the seller is a private seller then as far as returning for "change of mind", that's at the seller's discretion.
If the seller is actually a business but labelling himself for Ebay purposes as "private" then the seller is obliged to accept a change of mind return. It would then be at the seller's discretion whether to pay return postage or not.
That's the legal side of it. If the seller is a business but not declaring so on Ebay then he won't care about the law as he's already breaking it.
Bottom line is, for a quick solution, be polite and ask the seller if he'll accept a return and see what happens. If he says no, try again politely and then try Ebay.
As others have said, it may just be easier to resell it yourself..0

Just re sell it. You bought from a private individual not a business. The item is as described so you don't have grounds to return. You made an assumption instead of taking 30 seconds to ask the seller a question.
If you want all your consumer rights then buy from a business.0

Seller made a msitake in their listing, their problem. If it is listed as compatible with a device and is not, it isn't as described. Sellers have to learn that they have to describe things accurately.0

The OP repeatedly used the word 'assume', and there in lies the problem.0

OP says it wasnt compatitable with his device, hasnt said his device fits the the with what the seller posted0

Seller made a msitake in their listing,
 Where?
He didn't, he listed it would work with a model. Buyer didn't check if it worked with their model. First thing I would do, if there was doubt, is message the seller and ask.
If I didn't get a reply or not a satisfactory one, I'd move on.
It's a private seller, and as per the first post, who hardly sells anything (so not a business pretending to be private).
He has covered himself from people who buy the wrong thing, by saying no returns, something as an individual he is entitled to do.
OP should tell us what the item is and what sort of money we are talking about.0
