If, for example, the seller offers to take it back after I contact them then either refuses delivery or fails to refund.

If the seller offers to take it back why would they refuse it?

    That makes no sense.

If you are going to contact the seller BE VERY CAREFUL how you go about sending the message. You may just give them a defect for your own laziness.

I disagree with everyone. If the listing stated it was compatible with XXX then I would assume it would be comptabile with the whole XXX range. I should not have to check that. If it was only compatible with some of the XXX range then that should be stated. Whether the seller knew this is a whole other story.

Personally I would contact the seller and point this out. If they are a decent seller then they would offer a return, possibly expecting you to pay return postage.

If they refused or did not reply then it would be up to you. If you opened a SNAD case then I think you have a good chance at winning it. People have won them for far less. Or if you think you could sell it quickly and easily that may be a better way to resolve it. Personally I would contact them first and their response would decide if I opened a case or not.

Really, so what about 'compatible with iPhone'. Would you expect it to be compatible with ALL iPhones. Most people would enquire further.

Sorry, please don't take this the wrong way......

Are you expressing a personal opinion about how you feel the seller SHOULD be treated or how eBay WOULD treat a case such as this?

My initial reaction was along the lines mrcol1000 has expressed but I asked the question here to get an idea if I was being realistic or over optimistic.

I fear I would take quite a loss if I did that. The fact it is only compatible with very early models would surely reduce the value.

If you return the item you will get your refund. You can return it without the need for a case and retrospectively open a case with your tracking (showing delivery) in order to gain the refund.

But, whether that is what ebay should do or not is another question.

If you are happy the seller is out of pocket for sending the item to you, for the paypal 20p transaction charge and possibly the return postage, then your moral compass is somewhat misaligned.

You made the mistake in not asking the questions. The item isn't faulty and works with XXX item.

The item isn't faulty, you said so.

The item is worth less than you paid as it isn't compatible. That's the issue isn't it. You paid too much, thinking you had a bargain without checking first.
  • If the listing was vague it would be upto you to make sure it was fully compatible, that's what the ask a question feature is there for.

Going by what the OP has stated it is as described, it will work with earlier revisions of "XXX" but not later. If I was in the OP's shoes I would take the hit with it being my own fault for not doing my homework. Going down the route of a seller at fault return request or dispute would be very harsh.

So why should the seller take loss?

That, with respect, is your point of view.

As the listing said the item was for XXX I think it was perfectly reasonable to assume it was for all of the XXX range or, at least, the majority.

In this case the item only works with a few early models and is incompatible with the vast majority.

So, in my opinion, although I acknowledge some responsibility for not researching the matter in more detail, I feel the seller is at the very least equally at fault.

In fact, I'd be quite willing to agree a compromise with the seller but I'm not prepared to shoulder the whole loss, particularly if the rules of the eBay platform are likely to be on my side.
