Im I entitled to copies of the witness statement??
Hastings are disputing the witness statement due to apparent "inconsistencies"0 -

ask for ALL the witness statements as I wouldn't mind betting his dad will have been in the store or crossing the road or in the vicinity and 'saw the whole thing' even though it looks like he's come along well after the event.
good luck and don't worry, I am sure the insurance will cover it (likely that the child is on the dad's insurance and that's why he called his dad).just in case you need to know:

That's exactly what I'm thinking. It wouldn't surprise me at all as his dad is a nasty piece of work. He lives opposite my work mate and they've had some "altercations"

Yes, but some things aren't noticeable until the new panels are test fitted.
The door is wrecked and has been pushed into the wing. Hopefully the door has bent and the A pillar is fine, but we can't be sure until the door is stripped off the truck0 -
Is there any damage to the other car and, if so, where?
If the damage is to his near-side wing, door, etc then it's likely that you opened the door as he was passing. But if the damage is to the front of the other car, typically the headlamp area, then the likely-hood is that your door was already open as he drew up.
If the latter then I'm surprised Hastings are disputing it especially with a witness statement confirming your version of events. Did you take pictures of the damaged areas?
I'm pretty certain that any statement made by the boy's father would not be counted as reliable as he would not be an independent witness.
I would get back to your insurer and insist they get on with the job you are paying them for.0 -

There are often different stories from each side.
You can leave the liability argument to be sorted by your claim handler and Hastings.
Keep the pressure on A Ex to get things moving (they have a vested interest in allowing it to rumble on!)0
