vrgin extended my contract without me knowing

Options
I moved address in November and took Virgin with me. At that time virgin signed me up for another year contract without my knowing. They said they sent out a contract but I never received one at my current or old address. The cancelation fee is £350. I would have been open to a better deal from them but now I have no intention of staying even if it means I have to pay.

As I was not made aware over the phone and have signed no contract can they hold me to the fee? Do I have any options?

Thanks in advance,

Alan.

I was told on the phone that calls are deleted after 30 days however when I recalled a few minutes ago I was told they can access the database and listen to calls. I was also told on the original call that contract was sent to both addresses however when I recalled it was sent only to one address. The contract was never received so can they hold me to this through some small print loophole?

Your contract ended when you took left old house .

Fees are due to settle that contract .
But as the new house is in a VM area then they allowed you to take out a new contract and waive the existing cancelled contract fees .

You don't need to have received the contract for it to be valid .

You need to work out how much you owed VM for breaking your old contract and how much you owe them for the current service and decide if you want to pay out this sum to leave .

Its known as a rolling contract. Unless you specifically tell them you want to cancel within the specified time frame, your contract will automatically renew.

Ive been with Virgin for over two years there was only an 18 month contract. Sky do not set a contract for moving address. Surely you should be told if a contract it's in place? I'm going to write a letter of complaint and ask if they can access the original call and find out what address the contract was sent to. The first lady said it was sent to my new address before I moved in. If they told me I would have no issue and would have accepted. I would have even took a deal to stay because there service was great up to this point.

You are wasting your time. Most providers do a free home move, but it always starts you on a new minimum term contract-that's the trade off, and that includes Sky.
Why would any provider incur all the costs of moving you if you could leave the next day without penalty?

Sorry to jump on this thread and I am happy to start a new one if required but I have a simple question to follow up on the original post.

Does this rule apply even if you haven't moved address but just never renewed the contract? Virgin did this to me and the only reason I never called up to renew is because I was looking for a better deal elsewhere but apparently I am in a new 12 month contract!!!

You don't have to 'renew' your contract, if you do nothing it continues as before until you give notice. However, with VM, almost any change in your package/bundle will start you on a new minimum term contract, so that may explain it. But if you have never contacted them at all, they cannot put you on a new 12m minimum term. So ask them to confirm what triggered the new term.

A home move with Sky doesn't start a new contract unless you take a new service or discount as part of the move. If you move with your existing package, with no changes, then your contract continues as is. Even if you are out of your minimum term.
  • My brother works for sky and they do not extend contract for moving house. And Virgin have waived the early termination fee after it seems they made numerous mistakes and cannot prove I accepted a new contract. It just goes to show if you stand up for your rights you can be successful. A contract is a mutual agreement and cannot be set up by one party. They can't prove I agreed (because I didn't) there for there is no contract. Moving house is not an agreement as many seem to think.
The money saved goes towards a new tv.
Hopefully others will try as I did and not listen to the downers.
