HELP! I have been hit by and uninsured driver

So last night I was hit on the motor way by and uninsured driver. He did not stop and drove off I got the crash on video and his registration plate as well. I called he police straight away and gave them all the details and also my insurance. I now am at a problem my insurance company want to charge me £400 excess to claim and if they can not identify the driver I will lose my no claims and also have to have a fault on my insurance so it will increase my premiums for 3 years. I have been told about the mib but don't know much about it. If anyone can help me as of what to do please do I want my car repaired but why should I be losing out! I pay my insurance.

    Your excess is always payable, even in non-fault claims, the difference is in non-fault claims then you have a right to recover it and any other out of pocket expenses from the third party. If you buy legal expenses cover then your insurers will appoint someone to assist you with this but in this case if the driver is uninsured it'd be dependent on his ability to pay for these things personally.

    You may be able to claim from the MIB under the Untraced Driver Agreement given the vehicle can be identified, rather than claiming off of your insurance, but a £300 excess is payable and it will be much slower than claiming off of your own cover. This may be fine if your vehicle is still driveable but an issue otherwise.

    Of course if the driver is traced it may well turn out that he does have insurance as he was using DOC extension of another policy or a trade policy etc but that wont be known for some time

    have you checked the insurance status on the vehicle with MID to see if the vheicle has third party insurance held on it for purposes of the road traffic act.
    I do Contracts, all day every day.

    Will there be a time limit to claim with the mib?
    I just don't understand how I will have to lose out no matter what. All I was doing was driving home from work and getting hit by another car I did nothing wrong but I seem to have to pay for some one else's mistake

    My insurance company have done the check and it came back with out insurance they have sent a request to the dvla to find out the persons name and address

    I am sorry about your accident Jackee, and I don't want to make you feel worse, but the section of your post I've quoted seems to imply that you had a camera (on your 'phone?) in use prior to the crash in order to capture it. If you were using your mobile at the wheel your insurers and the Police might not be very happy about that.

    The above is the FAQ on making a claim. It is poorly written unfortunately.

    I am not aware of any specific limit on the MIB claim in which case you have the generic limitations act which is 6 years for property damage and 3 years from date of knowing for injury.

    Why do you lose out? Because thats life unfortunately. Why do some people get struck by lightening or have some idiot randomly mug them?
