where do i stand...

So 3 months into a vodafone contract for my wife's phone, it starts overheating and on charge i can smell a burning smell. Phone still turns on and semi - works however i get random reboots and it gets hot as well as me not feeling happy having a red hot phone charging and smelling funny with kids in my house.

sent off to Vodafone repair shop - 1 week later they send back and say it can't be fixed and due to internal damage (burnt out) to the charging port. They say to call vodafone who then say in a nut shell bad luck. no refund, no replacement and no exit..... so at present they will get 1k off me over two years for just airtime... great!

my wife used the official charger and we have logs of us calling them to say the phone is acting oddly and getting hot on charge.

I fail to see how this is our fault....

struggling to get anyone at Vodafone in store or online that will help...

i am so angry right now that they are at present going to walk away from this with the whole bad luck view

please any advise would be great

Micro-usb ports are, possibly, the most delicate point of modern phones and are really easy to damage by applying excessive force.
If it's mechanical damage you are unlikely to get anywhere.
If it's not mechanical and the phone was supplied by Voda, then they are giving you runaround instead of fulfilling their duties under the SoGA.

Demand a more meaningful explanation from Voda than unintelligible 'burnt out'.

  • looking in the port you can see it is burnt inside, no physical damage but clear some internal heat damage -

Well, ask them what exactly they are blaming you for. If it's not your fault and they can't repair it, then they have to replace it.
Don't give in easily. They are notorious for inventing excuses to avoid their obligations.

    What about the manufacturer's warranty?
Did you keep charging it once you detected the burning smell?

Samsung give a 24 month warranty on their handsets. Assuming the Note 3 was new when you got it you should call Samsung if Voda won't do anything. This is definitely covered under the manufacturer's warranty so don't be fobbed off.

What does Samsung have to do with the issue? You can't just call Samsung if you have a fault with a Motorola Nexus...

Damage is not covered under Samsung's limited 24 months warranty .
Vendor has presumably refused under SOGA as its user damage .OP needs to see the repair report from the vendor as to the cause of the damage . .

OP doesn't have a Samsung, they have to deal with Google or Motorola (who offer a 12 month warranty).

If it's due to a charger fault then why is it not covered? We don't know the actual cause of the damage from the info given.
