    Report offenders to their ISP.
Charge offenders for the administrative costs of identifying and removing their posts at the rate of £40 per hour, plus any external costs that we incur.
Take legal action to recover these costs.
Report offenders to the authorities if their actions appear to amount to a breach of the Computer Misuse Act 1990 or any other relevant criminal legislation."

    From the T&C's

15.1 Groceries delivered to an address with a Welsh, Northern Ireland or Scottish address will incur a flat rate carrier bag charge of 40p per delivery. We do not offer a delivery option which does not make use of carrier bags and the 40p charge will be added automatically to your basket. It is not possible to opt out of this charge. The carrier bag charge is not a Sainsbury’s initiative.
15.2 The carrier bag charge has been introduced by the Welsh, Northern Ireland and Scottish Governments. The profits raised will be donated to good causes in Wales and Scotland. In Northern Ireland proceeds will go to the Northern Ireland Department of the Environment.
15.3 Further information about the Carrier Bag charge can be found in our Help section .

Would love to see MSE impose these 2 rather onerous terms in court. I will wager a crisp fiver that they never have, nor ever would. Anyone from MSE care to prove me wrong?

It wouldn't stand up in court.

How many times do you see people posting under an "alias" (particularly on the "families" board when there's someone getting a sex change after being caught making love to their neighbours dog...)?

Many, many people have multis on here. If MSE were THAT serious about it, they'd ask for ID when each new account is set up.

I think my fiver is safe, and slightly surprised that those embarassing terms seem to have been written by an unpaid barrack-room lawyer rather than a real one befitting of a multi-million pound company (ie. MSE).

I am sure this thread will be read and commented on by nobody officially connected to MSE.

Oh, but they do. 35p regardless of number.

They may not charge where YOU live, but to simply state that they don't is misleading.

Careful he might say he is an expert in this field.

If the spotted baffffoooon on the checkout charge me for a bag, they can put the job lot back on the shelf!

Invest in some "bags for life".

However, strictly speaking, these should still incur the "bag tax", as you could only use them once, and you have to claim this back if and when you use them a second time. :)
If you fold it in half, will an Audi A4 fit in a Citroen C5? :)

The question to ask Sainsburys is why they are actively working against the spirit of the law.

As the Scottish government mentions on its website -

"For distance selling or when arranging delivery of goods, customers should be given the option to accept or decline using carrier bags. This is to encourage a reduction in the number of bags used e.g. using reusable crates instead of bags or where only a few items are ordered not requiring anything additional to carry them."

By charging a flat fee, there is no such encouragement.

I would not have thought that Sainsburys would have wanted to see themselves portrayed as destroyers of the environment, by failing to give customers the 'green' option of no bags.
