HSBC are waiting the full 14 days, the !!!!!!s
  • 14 days, your lucky! I was granted £180 back in May (8th May) and after several phone calls, costing me nearly £20 (by the time I am done, the refund would go straight to BT!), I STILL dont have any refund in my account.

I am about to call them and let them know that I am going to complain about their terrible service to Financial Ombudsman, my patience is running out now. All I want to do is get rid of Cahoot, but for some reason, they dont want to let even a "bad" customer like me go! Anyone got any other ideas on how I can get my money?
    Cahoot loan - £2000 - Cleared!
    Barclays - £1000 - Cleared
    Debt Collectors - £3000 - Cleared
    :T Debt free!! :A
  • I signed and posted back a slip to accept their offer last Friday, 20th July (they offered me £619 as a "goodwill gesture" - I only claimed £649!) and the money was in my account when I checked it on Tuesday, 24th July! Was so impressed :T
  • I was told 6 weeks by the F/O but when i phoned abbey yesterday morning she said it takes 10 working days for either a cheque sent out or money deposit in to account. because all cases are now put on hold they have more time to deal with settlment offers all banks are probably the same.
  • Recently won my court case through default (HSBC didn't submit a defence in time). I served judgement (through small claims court) on the 26th July, a day before the 'test case'! I asked for my money to be paid "immediatly" - it has been a week now but still no money ;

    1) How long should I wait before executing a warrant?
    2) Will they pay by cheque or just deposit it into my account?
    3) Is my judgement vaild as it was before the 27th?

Sorry if questions already been answered, I'm just a little confused and anxious!
  • I'm in the same position as you ie i too have judgement against Barclays now.

In answer to your questions, following the same numeration:-

    1. There is no specified time limit under the Civil Procedure Rules. I would however, suggest you write to the bank pointing out you have judgement against them and you want to be paid within 14 days of the date of judgement. You should then tell them in very clear terms that if they fail to do so you will apply for a warrant of execution, and that means bailiffs enforcing payment (the bank should understand what that means!) and additional costs (you will have to pay an extra fee for a warrant - usually about £55, unless yours is a very small claim). And if they don't pay up in time, enforce it! You're the one in control now and they owe you money! You can do it all on MCOL

    2. Not sure about payment method, but from wwhat I've heard, banks seem to be mostly crediting accounts. Remember if you receive full or part payment you are under a duty to tell the court about this (if you get part payment you can still ask for a warrant for the balance).

    3. Your judgement is entirely valid, unless the bank applies to set it aside, but the court would notify you of this and you would have an opportunity to oppose this (this can usually be done in writing)

I would recommend visiting www.hmcourts-service.gov.uk and clicking on "Forms and Guidance" as there are some very helpful online leadflets you can look or or print off. The Civil Procedure Rules are also on this site, and are quite easy to read and understand even if you're not a lawyer - these Rules govern all procedural matters in the civil courts and what the judge will apply in every case.

    Hope this helps!
  • OK i am new here, have been doing the bank charges refund for a while and have a letter from the natwest saying they are going to give me a sum of £3834.00 as a gesture of goodwll without accepting liabilaty or error. All sounds good but this was recieved last Thursday and is dated the 16th of July. I sent back a form to say that i was happy with the offer. They are going pay it directly into my account they said. How long do i have to wait. I still have no money from them on the Friday 3rd of August.
On another note the Abbey refused to pay out £2500. They were at the same stage as the natwest. Any idea why they delcined to pay out.
    Any help welcome.

I've read that it can take up to 4-6 weeks to receive the money. If Abbey have made you an offer and you accepted it, they must honour this. If they don't you have to grass them up to the FO.
