Get on the phone to paypal immediately- point out that you have full seller protection on the second one and have uploaded proof of postage. You should not have lost the fraudulent use of a card one- the other one unless it showed as delivered you should have refunded and avoided paypal deciding against you. That could be enough to mark you as an issue in paypal's eyes.
Allowing paypal to force a refund where an item shows as still in transit is not a good idea- but it is always worth appealing to them to at least unblock your account as you can show tracking (I assume you uploaded it ) that shows it has reached customs.
as case closed when i go to appeal case it wont let me upload any extra evidence although i did previous;y say it was at customs

Forget the one stuck in customs, you can't win that one- delivery is all that matters.

just off phone and they said basically if it is held in customs after 15 days it will eventually be on its way back but as 25 days have past to put in a claim for item inc paypal statement of payment etc etc
re paypal phone call - they said they will call back this evening so fingers crossed

I know you are obviously worried about the money potentially lost, but surely getting the PayPal side of things sorted out should be a priority as well. UPDATE re CHARGEBACK CASE
just to let you all know paypal contacted us today and have re-examined the case after i submitted extra evidence and they have NOW FOUND IN MY FAVOUR (SELLER) AND HAVE REIMBURSED ME
faith totally restored in the system
