Since 1st October 2014, the new keeper of a car MUST tax the car themselves - When the keeper changes, any existing tax disc (or tax paid separately after the disc was abolished) no longer applies, and will be refunded to the previous keeper.

This was very widely publicised. You probably got a flier about in with your new V5.
If you haven't done this, you have been driving and keeping the car without tax, and the fine is valid. Sorry.We need the earth for food, water, and shelter.

So basically I have a tax disc I know was bought legitimately and expires in mid 2015 but doesn't show up on the DVLA records.

The new system is a scam; the old keeper cannot claim less than a full month back on tax, and remaining tax cannot be transferred to the new keeper, so the DVLA pockets up to 2 months worth of tax on every vehicle transfer.
It's not a big deal for owners of fairly new modern cars which get tax subsidies, but for the rest of us who are driving older cars, 1 month tax is worth about £15 - £20. It's a stealth tax on the poor.0 -

It's only an extra 1 month tax they pocket for every transfer, no matter when in the month it occurs.
If transfer is on 1st of the month, seller loses that month, buyer pays for what they get. If on end of the month, buyer has to pay for a month they won't use. If it's on the 15th of the month, buyer and seller pay an extra half a month each.
I agree though it is a scam and a stealth tax.
A theoretical, but naughty, way round it is to fill in V5 transfer for last day of the month, so seller gets full refund, but then buyer doesn't bother to tax it till the next day (after midnight). IF buyer was to drive it straight home though, they would strictly speaking not be taxed, but camera systems wouldn't know that.
Safer thing to do is pay for car and fill in V5 on last of the month, then pick it up next day once it's taxed.
Alternatively, just pay the extra.
