What proposals do you have in place in case your Limited company goes bankrupt during the year?

Would that be a concern for a company with £228 in the bank and a net worth of minus £2672 ?

Also, from your website - Free Motor Legal is not an insurance policy, it is a subscription service. As such Free Motor Legal endeavours to provide all services described, however the services are offered at our discretion and cannot be guaranteed

So you can choose not to provide the service meaning that someone could cancel their paid-for service in favour of your service (and encouraged by you) and then be left high and dry?

We are transparent and open with our terms and make it clear that not all services can be provided, such as a hire car on a claim where there may be partial fault. Again, the same standards as facilitated by paid for policies and insurer-driven arrangements.

It would be wrong to imply that all services were available in any situation, because that cannot be guaranteed.

Indeed, people forget the impact of what happens when a company goes bankrupt.

I remember the impact Independent Insurance had when they went bankrupt leaving their customers needing to arrange alternative cover but still having to pay off the balances of the Independent premiums

    Yes we will.

You may be confusing our terminology of "51% or better chance of recovering damages from the other party" as an indication we can only assist people who are 50% or less responsible for an incident?

We assist people who can be 80% responsible for an incident, they still have a "51% or better change of recovering damages", as actual damages would be recovered. The damages would just be low as there would be 80% contributory negligence on their part, so the damages would be reduced by the appropriate amount.

Do you not agree that your website gives a false impression to customers about what you are stating a paid for policy does not cover. You're indicating a paid for policy will not pursue a similar case you have just given as an example to me eg 80% responsibility.

I wasn't referring to hire car etc

When you buy insurance you have protection such as FOS and FSCS. There is a legal obligation to provide the service paid for.

    You can simply say no.

Oh dear, Not gone well has it. I think it may have been better if they had not responded.

Want a shovel, or is the hole deep enough?

Will the website be altered to remove the bit saying it does everything a paid for policy covers?

.....The bodyshop issue may soon be changed to give freedom of choice.......

    So my comment is correct!

Saying you "may soon" change this is hardly a "correction"

In fact this issue was aired last year and you gave us this as your answer to the criticism that using your service means us being tied to all your suppliers and having to give up the right to use our own choice of repairer was answered thus

This is correct, although something that may well soon change. .....

How does your legal team define the weasel words "may soon change"?

In my dealings with claims companies, they tend to deduct 5% to 10% commission from the approved garages invoices as commission. I'm guessing this will prevent this company from offering free market choice.

I'm glad you reposted as I reread your first comment where you state the claimant "Must use all" of their services where applicable eg car hire, bodyshop, injury etc.

But when they responded to your question on this they did not address your question on having to use all of their services. But they later responded to my question as to whether they would just chase an excess eg where a client has used their own Insurer for damage repairs and not needed to claim for car hire or injury. They stated they would just chase an excess.

Clarification from them would be helpful otherwise we have to assume Quentin's statement was correct

No commissions are earned from repairs.

In the event a member has used their own cover and incurred just an excess or other small loss, they will be referred to the chosen lawyer to recover such uninsured losses. There is no minimum claim value.
