I am taking vodafone to court - my story.

  • I think he meant that the loser always pays is incorrect; he just expressed it very badly. In any case, you are normally only liable for court costs and small incidental costs in the small claims court - at the judge's discretion. That's why it works so well.

    I had a mifi device - was told it was capped - it wasn't - so it ramped up from £6.25 per month to £430 in 8 weeks - happy days! not...Ombudsman has been less than helpful, biased to vodafone and contrary to every bit of information that consumer law is on my side according to Consuemer Direct. Replies have been full of contradiction and they state they rely on "written" evidence which Vodafone does not ask for and when I asked if I needed to sign or document I was told I did not - but then Ombudsman says customer has to do this so buyer beware - the operaters are dysgraphic and do not properly record conversations. Citizens Advice solicitor though nice was totally ineffectual but did suggest I could try Small claims for "misrepresentation" and ask a judge to decide but I am unclear if I will just incur more costs! It just means it's not worth purchasing anything from Vodafone who obviously now rely on dubious trading practices - I suggest you see if your local trading standards has reported it to Vodafone headquarters neartest trading standards - the more they get consumer complaints they can build a case to take to Vodafone

  • I have laughed at the OP wanting £5000.00 and getting just £150.00 in the end, Total farce and if he/she had dealt with properly from day one instead of having a big hissy fit over this there would have been a quicker easy resolution. There are also Vodafone stores you could have gone into to drop off handset with a covering letter asking for a receipt to utilise the internal mailing system.


    Some people in my view like to create a storm in a teacup for no apparent reason, Yes you had an issue but I believe you went about this the wrong way and then got all pent up with Vodafone because they would not bow down to your ludicrous demands for such high amounts of money as damages, gog and so on.

    I read it as they got nothing as they went to court, that was a pre court offer which they rejected
  • So, in a small claims court you can only claim for actual loss? Where you have evidence of actual money that has been taken and they do not consider compensation for the hardship that may have been cause from the deprivation?

    Not in all cases if you took a Company to Court for breach of the DPA you can seek damages under the DPA which is not monetary loss but damages due to distress, Hard to win yes but cases are won on this basis also.
