When receviing my inheritance from my nan we had to wait three months when the company dealing with her estate got the sort code wrong.

Problem was the company had the correct bank details but had sent the money to the wrong sort code, at first they were saying the money had been stolen from our account and nothing could be done.

Complaints were made and the money got there in the end.

I'm afraid the instigation for investigating would have to come from the sender to his bank. The latter will certainly not discuss anything with you , hiding under data protection rules

If there's no satisfactory answer to the sender, he can take the case to the Financial Ombudsman

You may have a claim against the sender if the monies did not reach you in a stipulated time period

The Solicitors' Regulation Authority could also by involved by the sender....but really solicitors looking into other *ucking solicitors..?

    Thanks Paul_1977.
When you mentioned Complaints, who did you raise the issue to for Complaints?

With the company who was sending me the money, my argument was that it was the job of the company to get the money to me, what happened in-between was not anything to do with me. They did not like such talk but after arguing with them over the course of two months I got the money, don't know where it went in the first place but they gave me £100 on top which was not very good but better than nothing.

It was a shambles, first they said it had been stolen, then they said it had in fact been sent by cheque, and then they said these cheques had been cashed, and then they said there was never any cheques. total total shambles.

If you buy a sofa from a shop and ask for it to be delivered, the company would not turn around on the day of delivery and say the sofa had got lost and it was nothing to do with them.:rotfl:
  • Sort codes are not checked with bank addresses for CHAPS payments.
The names are checked so was there a problem there?

My guess is that funds have not left solicitor's account for either 1 They forgot to send it 2 The person who makes the payments was off sick or on holiday so nobody else could do it - assuming here that they process the payments themselves and not take them to the bank to do or 3 the CHAPS form was sent to the bank but someone at the bank has messed up.
To resolve this speak to the solicitor and get them to confirm the funds have actually left their account.

    Was this payment actually made?

    http://en.wikipedia.org/wiki/CHAPS

A CHAPS transfer is initiated by the sender to move money to the recipient's account (at another banking institution) where the funds need to be available (cleared) the same working day. Unlike with a bank giro credit, no pre-printed slip specifying the recipient's details is required. Unlike cheques, the funds transfer is performed in real-time removing the issue of float or the potential for payments to be purposely stopped by the sender, or returned due to insufficient funds, even after they appear to have arrived in the destination account.

The sender (solicitor firm) did send over a copy of the online CHPAS instruction record.

Did they show you a copy of their bank statement showing that the £50K have left their account, and not been returned to their account?

    Thanks Archi Bald.
No, they didn't show me their bank ststement, apart from the online CHAPS transaction record. I am going to dig that out tomorrow.
  • The online chaps instruction means nothing - you need to ask them whether it has left their account - if not ask them whether they process their own transactions or whether the bank does this.
If it is the bank the solicitors need to chase this up quickly.

Just thinking actually, You cant actually set up an chaps instruction online, it has to be either done over the phone or in branch.

And normally solicitor firms payout in cheques rather than bank transfers.

I wouldn't blame the banks just yet, Maybe go back to the solicitors and double check they actually got it sent.
