Please advise - new contract from Carphone Warehouse, can I change my mind?

Please can anyone advise me? After thinking long and hard about upgrading I have decided to go with a deal from Carphone Warehouse. Samsung S4 mini with Talk Mobile - 500 mins, unlimited texts and 500 mb of data for £15 per month, they also took off the upfront cost of £36 for me. They said they would cancel my contract with 3 and everything would be sorted. I want to keep my number so they said I need to ring 3 and obtain a PAC code. I have tried to do this tonight and I can't receive any texts on my new phone.


So the bloke on the phone with 3 was trying to persuade me not to leave them, he said my contract still hasn't run out and hasn't been cancelled as Carphone Warehouse are unable to do this. He said he can offer me the same phone with unlimited data, texts and 500 mins for £19.00 per month which is more allowance but I thought that by having less data allowance I can use wifi for any downloading I want to do, so why pay the extra?


Now I am in a quandary, I didn't get the PAC code after all as I don't know what to do. I have looked at Carphone Warehouse website and they say there is a refund policy within 14 days of purchase.


Is the 3 contract a better deal or was the bloke on the phone just trying to persuade me to stay with them?


I don't know what to do now. My current phone with 3 is the Samsung Galaxy S3 mini by the way.

    Tried to do what? Why can you not use the old phone?

    Did 'the bloke' offer you less data for smaller price?

    Only you know what you want/need. Ultimately you can use your phone on wifi only without calls and texts. This will cost you nothing.

    I assume you've bought your contract over a phone as you say that "They said they would cancel your contract". If so, you do have 14 days to change your mind.

    Define 'better'. All depends on what you need.

    Thanks for your reply. I am managing to use my old phone now, at first texts weren't coming through but they are now. The bloke at 3 didn't offer me any less data, he said I can have the same phone (S4 mini) with more allowances and just for four pounds more. I do use the Internet, mainly for Facebook and browsing and sometimes download apps and go on You Tube but the girl in Carphone Warehouse said I can just use wifi to do that and then it won't eat it my allowance. I guess I am worried that if I get the lower allowance I may end up going over it. I thought CFW had cancelled my 3 contract but on phoning them I have been told they haven't.

    So 3 will give you unlimited data and an S4 for £4/month more? When you say the 3 contract has not run out I assume you mean you are free to cancel with no penalties but the contract is still active? Do you generally use more than 500mb/month data? if not, you'd be better off with CPW. Did you sign up to the CPW contract in store, by phone or online?

    My 3 contract ends this month, I was told on the phone tonight that there is a £9.00 cancellation fee which I don't think is correct because you can usually cancel a month before with no charges. CPW did say they would pay off my bill with 3 for this month. I signed up in store with CPW.


    Last time I checked with 3 they said I wasn't using 500 mb data allowance though at CPW they said just downloading an app takes loads of data, as does You Tube and watching TV.


    I just don't want to go for less data and end up overusing it, I would like the freedom of knowing the allowance is there but at the same time I am really wanting to keep my bills down.


    3 did offer me a while ago in store a SIM only contract for £10 per month with unlimited data but I think my phone may cut out soon and I don't want to have to fork out for another handset yet.

    Before you do anything you need to check that the CPW 14 day cancellation policy applies to in store purchases. I'm not sure it does (I may be wrong) but I believe the 14 day period is only applicable to distance selling regs. So don't go signing up to any new 3 contract until you know for sure.

    No charges on the top of what you owe until the end of the minimum term.
    I signed up in store with CPW.
    Why do you think that you have 14 days to change your mind then?
    On the website they clearly say that it's only if you bought online or over the phone, including the Click & Collect option

    Talkmobile allow 14 day cancellation according to the CPW website.

    So it looks like you are stuck on the CPW contract. You can prevent yourself going over your data limit by using the data usage limits on your phone to stop sending data if you hit 500mb for the month. Just make sure you set your apps to only update when on wifi.
