    I think I have finally sorted this out now? but just need a bit of clarification. I have managed to get my name added to the tenancy as a joint tennant so do I assume this is correct or do I need a separate tenancy agreement. Sorry its been so long but the landlady lives abroad and has only just popped back to the uk. Also when I make my claim I am presuming I only claim for 1/3rd of the rent? as my daughter who is the joint tenant with me has a 13 year old son. Thank you

    Half..under 18 year old's won't be liable for the rent. You might have an informal agreement to go 1/3 and 2/3 but it's actually half each between you.

    this is correct.

    I'm a little confused now as I was given the above advice earlier. ????

    bcause your daughter is a non dependant rather than a lodger.
    the fact you receive DLA means that there would be no non dependant deduction from your housing benefit.
    i have no idea why you would make your daughter a joint tenant, you were clearly advised against it.
    as a family, with you as the only tenant, you would have been entitled to the 3 bed rate of LHA.
    now, as a joint tenant, you are entitled to half, leaving your daughter to find the rest.

    Sorry if it seems I have messed things up a little but since I posted originally my daughter was only working part time she is now in full time employment on £16000 which I believe now makes a difference ? also I wanted to make sure that if anything happened to me she will not be thrown out. Once again I do apologise for not being clear :o:o:o

    It wouldn't have made any difference. You were entitled to 100% of your rent met by HB. I do however understand that you wanted to secure her a tenancy. :)

    How do you get all your rent paid for you in a 3 bed if only 1 of you? Was curious as I had a 2 bed and had to pay 14% of my rent even though I was on high rate DLA and ESA. I am now in a 1 bed

    The 14% is a reduction in your HB as you are under occupying. This only applies to social housing.

    The OP is in a private rental. It is possible that the rent she pays is equivalent to her one bedroom local housing allowance or she may be getting it topped up by a discretionary housing payment or there may be other circumstances that the Op hasn't divulged.
