    someone I spoke to reckons the reason the code does not work is because they have already held the appeal and made a decision, I just have to await their verdict.

    Any chance this is the case?

    Thanks guys, unfortunately had to be away on a family emergency (electrocution) all ok now but no time to work up a rebuttal so have submitted my own prepared earlier.

    Hi

    Just to let you all know that my appeal to POPLA was a success. The main reason given by the adjudicator Nozir Uddin was that CPS failed to produce a contract with the landowner allowing them to issue parking charge notices, I quote, "the Operator does not have the authority from the landowner to issue parking charge notices".

    This was the only point given consideration and was sufficient.

    Thanks to all for support and encouragement, and to those in the same hole, it can be done.

    Well done!

    It is sad that 2 years down the line operators continue to fail at POPLA but instead of changing their practices to become legal, they move instead to a kangaroo court. You would have lost this at the IAS because they would have required you to prove the operator had no contract. Quite how they expect you to do this is a mystery. A night-time raid on their head office, complete with balaclava and digital camera?

    Indeed but the question should be properly directed at the IAS whose entire approach is Kafka-esque. That said, in such a situation a statement signed by the landowner to the effect that they have no contractual arrangement with the PPC might just do the trick. Snowball in hell I accept but that is the "reality" of IAS World.
    My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

  • All- i too have just been told this lot have ceased trading having taken on my case. Basically it was a PCN from VCS ltd for stopping momentarily outside John Lennon Airport Liverpool. PTAS lodged an appeal on my behalf though i don't have the detail of what they actually said on my behalf. I received an automated acknowledgement from VCS who said they would get back to me within the timeframe as long as i had provided all the correct info, which i can only presume was provided, PCN number, registered keeper and or driver details, serviceable address etc. They didn't get back to me within that timeframe but a couple of days before it was due to end i got a final reminder notice for the charge.

    I'm told i should just ignore any further correspondence given that i have had an acknowledgement from them but then no actual response to the appeal????

    Any advice greatly appreciated
