  • I have the unenviable situation of being on incapacity benefit meaning I get paid on a 14/28 day cycle, meaning that it isnt always possible to have money in my account on the 1st of the month (even with the best intention) as having 3 kids and a partner on maternity leave leaves us much shorter than usual.

    therefore over the years I have ammassed roughly $1300 in charges.

    I try to keep things on an even keel but it isnt always possible.

  • if you want to win just mention THE BILL OF RIGHTS ACT 1689 i did with my bank and got all my money back, however you may have to wait until after the test case

    This is something I (and possibly many others on these forums) have never heard of... Would you care to elaborate a bit on it?

  • I know not many people has heard about it but it is one of the most powerful laws in modern day

    Firstly that this law is not law is scotland, you do have a claim of right but don't know if it does the same things. A good bet be looking on the statue law database and put claim of right


    The Bill of Rights Act 1689 was put into place to put forward certain rights for people some are in the human rights act

    But Section 12 of the act provides everything you need

    It says

    "That all promises of FINES and FORFEITURES of particular persons before conviction are illegal and void"

    Bank charges qualify in my eyes as a FORFEITURE therefore illegal under the act

    Other things which takes a fine or forfeit like london congestion charge (when it fines you) parking tickets or any other fine or forfeit is illegal

    Also if you go to court (not small claims) for not paying the london congestion charge ask for a jury. The judge probably say no but it's your right under Section 29 of the Magna Carta 1297.

    I started my claim with Lloyds back in June with the 28 days falling the day after the trial case announcement. I have now progressed to claiming financial hardship and am not getting any further forward.

    One bit of praise that I can offer to Lloyds is the fact that they have waived 2 months of fees in an effort to get the account back on an even keele (approx £400) and I am also paying my overdraft back at £16 per month. The lady who helped me sort this was really helpful and agreed that it a viscious circle and she hopes that I get to reclaim my charges.

    Surely he must have known the size of the defense of the banks case.

    Earlier the judge commented on the scale of material under consideration, describing the volume of evidence submitted as an "enormous burden".

    What did he expect,I believe 7 banks and 80 briefs giving a defense.

    Now this might go on into the middle of February,FOS claims could take 6 to 9 months to sort out,then really give no results

    A true hornets nest has been disturbed,if the banks win even at a reduced agreed rate some serious re arranging will be needed by all.

    The banks were not taken to court,they agreed a test case.

    When its all over,will they be looking for the people that disturbed the hornets nest.
