  • How long do these things take? Or is it a "how long is string" type affair?
  • The case is scheduled to start on Wednesday 16th January at 10.30. It is expected to end on 28 Jan.

    The venue is the Royal Courts of Justice (Admiralty & Commercial Registry) in the Strand.

    A judgement on the case is not expected until May.

  • I think May would be rather optimistic I'm afraid. Assuming the OFT win, the banks are certain to appeal. As the right to appeal is written into the the test case agreement it is unlear that the waiver and stays would be lifted before or after any appeal.

    Depending on the judgment, the OFT will launch a second case to prove that the fees are illegal/unlawful. I have always thought, and still think, that the entire proccess could take several years to reach a conclusion.

    Sorry to put a downer on your day mate, I'm just being realistic. All we can hope is that if the judgement goes the OFTs way - and there is'nt much doubt that they won't - the resultant publicity - which I would imagine would be an international story - that the high court has essentialy ruled that the banks have been systematically robbing their customers - would be enough for the powers that be to act sooner rather than later.
  • I cancelled direct debits a year ago when I changed banks, the building society was has been charging me or unpaid dds that I cancelled an now its gone a debt collectors that say there going to take me to court for refusal to pay four hundred & seventy-three pounds! I wrote to the bank last year but they were adamant they want "there money". What do I do now?

  • I was told by Abbey that the test case is expected to last 8-10 days. Could Martin or any of his helpers (i.e. people who know a lot more about this than me). Give us an estimated time frame of the proceedings. I have read in this thread that Judgement may not come untill MAY! and then there are appeals, counter appeals etc etc and so on. Some clarification to the layman may be usefull here. IF the OFT win, when would the backlog of charges be dealt with? What happens to the waiver? Lots of questions and seemingly few clear answers.
    I Reject your reality and substitute my own.

    When life gives you lemons, throw em back and say you want CASH instead!

    the details of the stay on my case stated that it is stayed until the outcome of the OFT test case, not appeal cases etc. Does that not mean that i can then go back to the court at the end of Jan and reopen my claim? or do the courts do it automatically?
    Barclays - Reclaiming - £3380 - stayed 30/08/07 - £2261 goodwill 20/02/09
    Abbey - Reclaiming £250 - 1st letter - stayed
    MBNA - Reclaiming £400 - received £294
    Morgan Stanley - Reclaiming £138 - received £120
    MINT - reclaiming £110 - received £90
    A&L - £170 charges - £170 back!
