  • Hello, I've been told by Abbey that I can't even get my last 6 years of bank statements because my account with them is closed. It closed because I refused to pay their bank charges which made me go overdrawn by £195 and the cheeky so and sos passed it on to a debt collection agency!!! Is there anything I can do? I was also on benefits at the time if this helps at all? Thanks :)

    Firstly have you sent a SAR (Subject Access Request)?

    If yes and the 40 days are up then you should make a complaint with the ICO (Information Commisioners Office) if they are refusing to supply you with the data you require. They have 40 days to do this and if they fail to then they are in breach of the DPA (Data Protection Act 1998).

    No you don't have to leave, however it is advisable to set up what is known as a parachute account just in case they get funny. I set one of the up at HSBC and have only ever used it to recieve charges back from HSBC LMAO.

    However if you make more than one claim then sometimes they write and suggest you may want to bank elsewhere if you cannot accept their T&Cs.

    I am currently on a work permit and therefore if/when my job contract terminates, I have to leave UK for my home country, closing my bank accounts in a short notice. Therefore it is difficult for me to wait for many months for this Bank charges OFT case to resolve. And even if it does resolve, it will be hard for me to receive any cheques from HSBC because of the unsafe nature of postal system in my country.

    I just wonder can I make a claim in the court (or to the bank) in view of this situation?

    Ive been away from the board for a while.
    Had my case against the Abbey stayed last year so decided to sit it out and wait until the OFT case was heard this month.
    Just wondered if anyone knows that when the OFT WIN the testcase - how long it will be before the banks start to move or our stayed cases are dealt with?
    My last correspondance with the Abbey was to say that they will defend against me all the way, so I dont suppose they will be in a rush to pay me out.

    Hi My Case Was Due To Be Heard In Sept And I Havnt Heard Anything Yet ........will This Go On For Ages Would U Said Ive Missed This Or Is It A Case Of Waiting Patientally??

    DEfinately a case of waiting paitiently, and keep up to date by signing up to Martin's email every week, I think the case was put back a couple of weeks so may be towards the end of January, depending on availability of the Court etc.
    Of course the big question is: Are the banks going to defend against the OFT, as if they do they will have to disclose the 'real' costs of charging us all the penalties that they do charge, and if they do that everyone and their grannie knows that it wouldn't cost £35 to do this, so the Court's would hopefully find in favour of the OFT.

  • As i understand it the test case should start tomorrow 8/01/2008.

    Can anyone confirm this is correct. If my dates are wrong what is the correct date that has been set?

    I knwo this is probabably a completely dumb question but here goes...

    When does the test case end? Someone told me it is next week! Is this right?

    I am not sure and cant find any info on Google about it!
