Whether you can start after the test case depends on how old the charges are if they are nearly 6 years old then you should issue to avoid the limitation act point being taken but if they are not that old and you can do then it may be an idea to wait.
Thanks ... I assume that just writing to the bank to tell them that I am going to issue proceedings within fourteen days and then not doing so does not matter if I then have to start the process all over again. Does anybody know?0 -

have applied for judgement by default on a case which was posted 15/08 because Abbey had not replied before the end of the 14 day period and have been told its been accepted on moneyclaim. Does this mean i'm going to get the bank charges returned or am i still going to ahve to wait for the overall governments verdict?0 -

If you have not recieved the money due under the judgment in 14 days apply for a warrant of execution to get the bailiffs in.As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person0 -
I have recieved my letter today, explaining the legal issues that are now in place. Do I now continue with the 2nd letter or "hold fire"? I'm soooo confused. P.S. Amazing how much in charges you build up over the years without realising. Loving your work0

I have three accounts at Lloyds TSB. Cash account, Sole Trader and Limited account. They sent charges details for Cash account but left me a message asking me to call them as they cannot give me the business account details due to information restrictions. Can I reclaim charges on a business account? Has anyone done this? Thanks. Joseph0

My husband and I started the reclaiming process back in February this year. We went trhough all of the steps, declined a (lower) offer from HSBC and were planning to see them in court on the 19th September.
However, on our return from holiday last week, a letter from the bank informed us that they were planning to ask for a stay on the case. The hearing to apply for stay is on Monday (17th September). We would really appreciate all the advice we can get as my husband (the claim is in his name) is going to argue against the stay and it says in the latest article on MSE that "detailed research, preparation and an understanding of the court process" is necessary.
HELP!

My husband and I started the reclaiming process back in February this year. We went trhough all of the steps, declined a (lower) offer from HSBC and were planning to see them in court on the 19th September.
However, on our return from holiday last week, a letter from the bank informed us that they were planning to ask for a stay on the case. The hearing to apply for stay is on Monday (17th September). We would really appreciate all the advice we can get as my husband (the claim is in his name) is going to argue against the stay and it says in the latest article on MSE that "detailed research, preparation and an understanding of the court process" is necessary.

Hi, I sent my first letter to HSBC on the 19th June but have still had no response despite follow up telephone calls. Any suggestiong on where to go from here or advice on where I stand? Have been advised that they purposely didn't respond knowing the intervention of the ombudsman.0
