  • Am I legible to reclaim these charges if I no longer hold a current account with one of the major banks but still have a loan with them, as it was down to the bank that debt issues started?

    Yes you can still claim from closed accounts
  • I am in a dilemma! my claim was filed on moneyclaim website in june, the recent ruling says all claims after 15th august are to be stayed. i have had a letter saying that my case is to be stayed until.30 9 2008!

    as my claim was filed before this date, would i have grounds to ask for the stay to be removed?

    Same situation as me (but HSBC for me) - HSBC have applied to the court to have the judgement set aside. They are quoting many reasons and one of them is the OFT announcement - which obviously pre dates our judgements.

    I'm just waiting to hear from the court now as to what the next steps will be. As you issued a warrant (I didn't get that far) then you should be contacting the bailiffs and intructing them to go and collect what is yours!
  • HSBCcharged 25 quid last month and another 25 due next month why are they still charging after this law. are they hoping it won't be challenged?

    There was a piece on Radio 4's "Moneybox" programme at midday today with the latest info on the impending High Court case re bank charges. Martin was on, PLUS a really sanctimonious woman from the banks !!

    Keep putting your claims in at the court ... write the letters and stick to your timetable max 28 days - they still have to respond in a timely fashion this OFT announcement doesnt give them carte blanche to do what the hell they like.

    Get your claims in, especially if you think you may be considered in hardship - ie on benefits, in huge debt and at risk of losing your home etc, or if you are ill/disabled.

    Take it through the courts and if you are given a stay at allocation stage then we can help you fight it individually based on YOUR circumstances. Templates dont work the court needs to have reason to consider your case on its own merits.

    Hope that helps - please dont give up if you NEED this money

    Unfortunately the ruling does give them carte blanche ! This is what Martin was complaining about on the programme - the banks can quite legitimately not pay out any more claims BUT they can still carry on placing "unlawful" charges on people.

    A bit one sided !

    But as you say, cases of severe need will be considered on their merit.

    i just got letter form court yesterday saying my claim for c c aharges had been stayed,i was gonna use a template letter to get it removed,but ive just read on here not to do that,can anyone offer any help?

    HOW DO YOU GET A STAYED CLAIM HEARD ! any advice my boyfriend has 5 pubs , well 4 now had to let one go after the smoking ban !!. He is claiming back a total of £10,000 in charges and all the claims through the court have been stayed. Have read on this site (l think) that someone still had their claim heard or had the order set aside. He is now looking at to lose another business and this money could help save it. Anyone any advice on how its done , l think the arguement that 9 jobs could be saved is valid please help !
