    The courts(probate) won't check anything other than the person is entitled to get the grant.

    Any checking will be done by HMRC.

    There are around 1/2 million estates every year,

    of those
    around 50% go to grant(probate/LOA) for their administration
    of those
    around 85% are with a will
    around 35% are by lay persons
    around 60% are for under £100k

    of those only around 16k pay IHT.
    (as the new house bit kick in this number will be reduced significantly)

    That number could be a lower if everyone did a bit more planing.

    The costs of checking every estate in the uk would be prohibative.

    The Oath came today as promised with one of the copy Wills I had sent.

    5 Minutes taking the Oath at a local solicitors cost £7 no appointment necessary. The solicitor and I both had to annotate the copy Will which was then sent with the sworn Oath back to the Probate Registry.

    The Probate Registry's letter says that they aim to send the grant in 10 working days from receiving the sworn Oath.

    Another little update, swore the oath yesterday, posted back last night 13.10.2015, so I will keep informed of when I receive the next piece of information.

    As long as no caveats have been entered, you should get the grants back within a couple of weeks. 14 days later, the will & grant will appear in the online database so that the general public can obtain copies.

    The Probate Registry told me my grant had been posted yesterday.

    They also told me that their aim is now to post the grant back within 8 working days of receiving the sworn oath.

    I have had very good service from the London Probate Registry.

    My papers came back today, two weeks, very quick!

    Can anyone tell me what I do now, is it just a case of taking that paperwork into the bank, he held all his accounts at the one bank.

    Assuming it is just your name listed as the executor, take a couple of copies of the grant with you to the bank along with two forms of ID (passport & utility bill are usually OK). Sit down with the branch manager and go through any forms with him and that should be job done.

    If there are two executors, you will both need to go in to sign any papers.

    Do not expect to get the funds straightaway as forms have to be filled in which generally have to go to the bank's Head Office.

    I got my funds 2 weeks later.

    You need to take an original death certificate if you haven't already given one to the bank.
