Highview PCN on hire car

My mum got a letter from Enterprise car rental that they have received a PCN from Highview for staying too long in a car park.
Enterprise have charged her £35 admin fee for sending the letter and Highview want £85 for the parking charge.
From what I have found from another forum, Enterprise's Terms say they are obligated to forward the driver's details for fines & penalties from councils/police/parking agencies. But as this is not a fine as such, I can argue the fee and, why are they obligated to forward driver's details to a private company who are sending an invoice. That must be against some data protection rule?
Enterprise say that Highview will now reissue the PCN to my mum and we can use the guide to fight that one separately.

    enterprise cannot charge your mum as its only an invoice , not a fine

    they should have followed the BVRLA MoU guidelines from 12 months ago and named the hirer of the car (the keeper - your mum)

    then she would get a PCN in the post and can appeal it

    she should tell them she will claim a chargeback or unauthorised payment and will get back any money taken for this minor task, all they had to do was name the hirer of the car, nothing more and I doubt their terms and conditions cover private invoices from non-authorities

    if they cannot follow the guidelines of their own trade body that is their problem, not your mums

    they cannot name the driver as they have no idea who was driving, it could have been you or me driving the car , or somebody who took it for a "joyride"

    when she gets the pcn in her own name, she should send the template letter, as keeper (not as driver)

  • Thanks a lot. Actually they could'nt have known it was definitely her because she put me on the policy because I borrowed it a couple of times as my car got written off over xmas by a drunk driver. Thanks for the links.
