    But to go back a few posts, merely being open is not enough. You need to know how long it has been open.

    Without that, attributing guilt to one part or the other is guesswork, so both are guilty.

    The other party said the vehicle was unattended. So unless it opened itself it was long enough not to be opened into the path of the OPs car. So OPs fault.

    Ever seen anyone ever leave a car door open on an unattended car on a petrol forecourt (on the non-fuel pump side)?

    Seriously. Someone would walk away from their car that has nobody in it, with the door wide open, so that anyone trying to use the pump on the other island is blocked from using it?

    If they stick to that story without cctv they'll be found not to be at fault as the OP can't prove otherwise. They've already said they didn't see the door opened.

    And nobody will believe that they opened the car door, and walked away from an unattended car.

    So they come across as liars, and the OP as more believable.
