jojonana - as uknick asks - surely you have a mark on your bumper - is it on the side of the car, or the front? You seem to say it's right on the corner?

Yes, any collision with a stationary object is the fault of whoever was in control of the moving vehicle, sorry. Even if he whipped the door open quickly in the hopes you'd hit it, you're still at fault.

    So much tosh.

So you are parked on a normal two way road, with cars and lorries zipping past within the arc of the door at 30mph, 40mph, 50mph or even 60mph, and you can just throw open the door without looking, and it is their fault they couldn't stop in time.

Oh look at that motorcyclist that is bouncing down the road. Never mind, their fault they are now in several pieces.

I don't know why there is much discussion:

I pulled into a petrol station
As I was lining up with the pumps
I heard a sickening sound, and realised
I had hit the open door of the driver next to me.

    Case closed.
Driving without due care and attention.
I suspect you will not like my post.

In reality, the other driver should have checked but drivers these days don't drive like they used to.
You can try and approach from that angle, but highly likely you will be at fault, of both of you will be at fault.

    Depends on the timeline.

How long was the door open before the OP hit it.

Five minutes - Guilty as charged
1 second - Innocent of all charges.
    Somewhere between - Hmmm

The problem is without the cctv the OP cannot answer that.

But neither can the owner of the other car that is claiming from the OP.

So in the absence of either being innocent, both must be guilty.

I didn't realise the other driver had posted.

The update from the OP -

Update Heard from the insurance company today. The people in the other car have said that I hit their car while it was parked, and unattended!!!

If it was unattended they can say how long it had been open. Maybe since they left it or did it open itself?

I'd say they have more of an idea than the OP who didn't see it open.

    Maybe, maybe.

The point is that both are claiming innocence, so in the absence of proof, both are guilty.
