Yes, any collision with a stationary object is the fault of whoever was in control of the moving vehicle, sorry. Even if he whipped the door open quickly in the hopes you'd hit it, you're still at fault.
So much tosh.
So you are parked on a normal two way road, with cars and lorries zipping past within the arc of the door at 30mph, 40mph, 50mph or even 60mph, and you can just throw open the door without looking, and it is their fault they couldn't stop in time.
Oh look at that motorcyclist that is bouncing down the road. Never mind, their fault they are now in several pieces.0 -

I had hit the open door of the driver next to me.
Case closed.
Driving without due care and attention.
I suspect you will not like my post.
In reality, the other driver should have checked but drivers these days don't drive like they used to.
You can try and approach from that angle, but highly likely you will be at fault, of both of you will be at fault.0 -

The point is that both are claiming innocence, so in the absence of proof, both are guilty.0
