Yes, any collision with a stationary object is the fault of whoever was in control of the moving vehicle, sorry. Even if he whipped the door open quickly in the hopes you'd hit it, you're still at fault. You were following him in, you must have been able to see that he'd parked awkwardly as he slowed down.

Update Heard from the insurance company today. The people in the other car have said that I hit their car while it was parked, and unattended!!!
This is total fabrication. Why, If these people are not at fault would they lie like this?0 -
And .. why would anyone park a cer and leave it with the door wide open??0

For a bit of clarity OP - you say your 'car bumper' - it's important here whether it was the front (you hit him) or the side (MAYBE he hit you) of your car - can you answer?
From what I can remember, it was the rounded corner part of my car.

I know it wouldn't make any difference whether he left the door open or not with regards to your liability. But who really leaves the drivers door open when getting fuel? Especially if the vehicle is unattended.
I have on one occasion seen it done and a cashier refused to dispense fuel until it was closed.0 -

Contact them yourself. CCTV is usually wiped after so many days, so if the insurance company drags their feet the evidence might be lost.What will your verse be?

Get used to it. It's a victimless crime for some people. One of my family members was involved in an accident which was clearly the other drivers fault. He told the insurance company a complete pack of lies which were proven to be false yet he stuck with his story and tried to argue 50/50.
Eventually, the insurance company settled against him but it took a good year before it was.0
