Ok, you've obviously got an issue with the police due to a previous experience, which I can't take away from you and wouldn't want to. However, I think its possibly clouding your judgement a little.
Starting with the charge sheet, it is just that. It doesn't show the evidence on it, the evidence only becomes known when disclosure happens prior to the court case, when the CPS have to disclose evidence to the defence.
Your own post said that your friend agreed to keep hold of some cannabis for a friend. Therefore the police can't be stitching him up, as he had the drugs! Whether it was his cannabis or not, he was in possession of it if it was in his house, so at the very least it is a simple matter of possession of a class b drug. Depending on the type (eg you don't say if it was plants or resin) he could be looking at cultivation if if it plants and he is tending to them, and depending on quantity there could be possession with intent to supply.
Seems odd that his house was raided. How did the police know he had cannabis? Sounds as if there was a tip off? Also, sounds as if there was quite a large quantity, as "raids" are not done for small amounts of personal use.
The police told you to !!!! off. Unfortunately, when going on a raid, they are looking to get in the house as quickly as possible to prevent any disposal of drugs going on. Wasn't the politest of things to say to you, granted, but if there are drugs in a property, the police often have no idea what else is going to greet them in terms of number of people, weapons etc, so were probably just trying to get you out of the vicinity, and also as you quite rightly say, it wasn't any of your business.
Sounds like an awful lot has been going on if it has taken 2 years to get to court.
The police can't send anyone down, thats the courts. They can charge people, and as I explained earlier, that charge is authorised by the CPS. The CPS also authorise exactly what the charge is, so whether it is possession, cultivation, PWITS (possession with intent to supply etc). Being charged doesn't mean you're guilty, or you've admitted your guilt, it means the CPS feel there is enough evidence for the case to go to court.
If the drugs were in a house shared by your friend and his partner, its only right that she was interviewed as well. If your friend is the one who was looking after the drugs and his partner truly didn't know anything about them, then I hope he has said this in his interview. If he hasn't, and has gone no comment or denied it, then there is every possibility she would be charged as well (you haven't elaborated on this, so don't know if this is the case or not). If your friends partner did know about them, but he has decided to tell everyone that it was just him and she didn't, then I'm afraid whilst that may be seemingly noble of him, its very misguided and unadvisable.
Going back to the quantity found, in my experience, if someone has a small amount for personal use, and they fully admit it in interview, then providing they are eligible (eg no cautions for similar offences or a list of pre-convictions) they would receive a simple caution. The fact that your friend hasn't would suggest that either he hasn't admitted to anything in interview, or there is a large quantity which takes it beyond simple possession or some other aggravating factor.
I'm sure you are cross for your friend, its clearly a worrying time for him and for everyone concerned. However, the only person that has caused this is your friend, as he was in possession of the drugs. Doing a favour for a friend isn't an excuse, and it appears he clearly didn't think through the consequences of what he was doing. Blaming the police might make you feel better, but if your friend hadn't taken the drugs to look after, he wouldn't be in this position.
I'm not having a dig at all, just trying to write it from another point of view, and from the way the law works.0 -
