Combined Parking Solutions Ltd - County Court Claim Form

I've spent a couple of hours going through this and other forums looking for assistance for my daughter.
A PCN notice was attached to my daughters car in May last year. It wasn't a car park she was parked in, it was some land below her boyfriends flat.
I researched online and was advised to ignore these tickets, which I did until my daughter received a letter from a BPCollins Solicitors. Again I came onto MSE forum and found a template of a letter which to send to the Solicitor asking for a Letter before Claim. Heard nothing back, letter sent in September.
In December another notice was sent regarding another ticket.
Now at the stage where a County Court Claim Form has been received today. Total amount to pay is £325.
I would like to think she can dispute the full amount. So stressed with all of this
any help would be appreciated. My daughter is coming here from work so will be able to ask if she still has photo's etc of the area she parked in.

Thanks Jim_AFCB I did have a read of that but i found it difficult to understand.
Do i just pay up??? I'm moving in the next few weeks and have a newborn and this is extra stress I don't need.0 -
No, don't pay !!
But, you will need to acknowlege the claim and state you intend to defend it - there is a time limit. You certainly must not ignore it.
More experienced contributors will be along, but for now, take some time to read the newbies thread and some cases in this forum to get an understanding of the issues etc, and what others have done to defend court claims.

I was starting to panic...thanks again. Will fill in form to say we will contest the claim.
The first time she got a ticket, the signs were home made and printed on A4 paper and sellotaped to the wall, the second time proper signs were on display. Her boyfriend parks there every night and yet has only been issued one ticket. I think the land is owned by an estate agents close by and on occasions they and their employees have blocked my daughters car so she couldn't get out.
No other cars that are there on a daily basis display permits.0 -
Is this a real correctly filled out N1 claim form?
Does it have a claim number and barcode?
Does it have the court stamp on the front page over the small circle that says 'seal'?
I only ask because some of the more disreputable PPCs and DCs send out what appear to be court claim papers which are not, normally poor photocopies with claim details but no stamp or claim number0 -
Normally well chosen cases taken to court by CPS. You need to get evidence of the signage. CPS signs normally offer free parking to those entitled or up to 24 hours for a fee, which they will argue is an contractual agreed amount.
The Wolverhampton legal eagle does have success with these cases. If the signs were right.

If they are claiming that this is a contractual charge then they have to charge v.a.t. Have they done so? If their invoice does not mention v.a.t. you may ask for one,which, if they fail to produce, not you can argue that this is not a contractual charge but a breach of contract and that GPEOL applies.
You can also then grass them to HMRC for fiddling v.a.t.You never know how far you can go until you go too far.0 -
I have received a pm from the OP which I have urged him to publish here. It is a letter from the PPC, the usual perky guff.

surely therefore they must be v.a.t. registered, so why no mention of vat on their invoice. We know he is reading this so lets hope he sends a v.a.t. compliant invoice.
It also appears that they pay the landowner £25 for every ticket issued, I wonder how many Residential Property Managing Agents they have on their books.You never know how far you can go until you go too far.0 -

Which court ?
Have you checked they are real, they do send fake papers out.
Who has signed the papers what do they tick to say they are Claimant or claimants solicitor.I do Contracts, all day every day.0
