    I hope you understand how it works. Do not try and argue "no loss" if the invoice is a contractual sum, (which should be v.a.t. compliant).
    You never know how far you can go until you go too far.

    ParkingEye Notice doent have any V.A.T Registration on it by the looks of it? I never answered any of the letters sent (Some of which I have never seen) The only letter I sent was when I got a County Court Buisness Centre - which I replied to them with....

    You issued me with a parking ticket on 11/07/2014 and although not on the Parking on Private Land Appeal’slist of grounds for appeal I believe the ticket was unfairly issued and I willnot be paying your demand for payment for the following reason:

    I was shopping with three other Shoppers who travelled with me at ....................

    Retail Park - Definition:


    a group of large retail stores in a city suburb.


    The fee is disproportionate

    According to the Unfair Terms in Consumer Contract Regulations 1999, parking charges on private land must not exceed the cost to the landowner during the period the motorist is parked there. In mycase, the £100.00 charge you are asking for far exceeds the cost to the landowner of “Free Parking” I would have needed to be charged £126.00 an Hour to make up the £100.00 for the over stay of 46 Minutes to justify the charge made by yourself. The Fee per Hour wa s“Free”


    The sum is extravagant and unconscionable Unfair Terms in Consumer Contracts Regulations (1999) Schedule 2 Section 5
    Unfair Terms
    5 – (1) A contractual term which has not been individually negotiated shall be regarded as unfair if, contrary to the requirement of good faith, it causes a significant imbalance in the parties’ rights and obligations arising under the contract, to the detriment of the consumer.


    Unfair Contract Terms Act 1977 - Clearly per the Act £100.00 for Parking over 46 Minutes is not reasonable by any stretch of the imagination

    If you choose to pursue me please be aware that I will not enter intoany correspondence and this will be the only letter you will receive from me until you answer the specific points raised in my letter.

    Ive had numourious legal letters about an inch thick that I have not got a clue about and I’ve submitted a standard by all accounts defense letter but now that appealparkingticket have done one and jogged off I'm fearing the worse for Friday I'll be carted off made to wear Orange and be a Plaything Thing for the Head Prisoner.

    New ones seem to spring up left, right and centre. They close quickly too after taking your money.

    Why not just use the information here and appeal yourself? It will be less stressful in the long run.

    I would not recommend that anyone pays money to any of these appeal helping companies.

    Smoke and mirrors springs to mind.

    I don't have any parking tickets to appeal, I was just commenting on there now being an active website behind the URL.

    Forgive me for asking, but do you understand the difference between liquidated damages for breach of contract, and agreeing to pay a contractual charge?

    Self righteous indignation and common sense do not apply in these matters, (although judges often apply them), these cases are won and lost by legal argument, and the side with the best advocate usually wins.

    PE will have a lawyer, who will represent you?

    No I have no idea at all - I'm completly lost on it all :(

    The claiment will not be attending at the hearing in order to minimise the costs but his advocate from LPC Law is going.

    They have submitteed a Test Case before HHJ Moloney QC and that was given in ParkingEyes favour.

    No one Im going alone.

    that was appealed which was heard in feb 2015 and the judgment will be out at 1030 this thursday the 23 april 2015 (the Beavis case)

    I would check on here and parking pranksters website this thursday morning, or afternoon, for a full update on that Beavis case
