I paid £16 for their service at the beginning of Jan 2015 for getting a £60 PCN for parking in a parent and child bay at Sainsbury's.

The guy on the end of the email advised me to wait until Horizon Parking (the agents for Sainsbury's) did the DVLA enquiry and wrote to me.

That has now happened but like everyone else I can't get hold of PTA, their emails bounce and the website is down.

Anyone got any suggestions as to what I should do? Feel like I'm up nasty creek now without a paddle, tempted just to pay the £60 and try and get a refund via PayPal for the £16 paid to PTA.

Anyone got any suggestions for me please? Anyone got any ideas of tactics used by PTA to get Horizon off my back now?
Whilst you sort out a refund from Paypal go to the Newbies thread - Click Here and do some reading - there's a fair bit of it.

You should also appeal to Horizon along to following lines:
    Dear Sir

    Parking Charge Notice XZXZXZXZ

I refer to the above notice and the Notice to Keeper I have recently received. As the keeper of the vehicle I wish to appeal against the issue of the notice.

It will be my case that:
    1. You lack any or sufficient proprietary rights to pursue charges incurred at the site in question.
    2. Your signage on site is insufficient to represent a contractual offer and in any event does not comply with the British Parking Association Approved Operator Scheme code of practice.
    3. The charge you are attempting to levy does not in any way represent a genuine pre-estimate of loss and is in fact intended as a penalty.
    4. Your documentation fails to comply with the Schedule 4, Protection of Freedoms Act 2012.

On the basis of the above I invite you to immediately withdraw the charge or in the alternative provide me with a POPLA code so that I may take the matter up direct.

    Yours faithfully

    ospre
This appeal WILL fail - but that is the objective. Armed with the POPLA code Horizon should now supply and the reading of the Newbies thread you will have done in the meantime you will be able to put together a winning POPLA appeals (there are several suggested draft in the Newbies thread).

My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com

Sorry if this is like the rest, but our story has got to the county court claim form, we probably did the wrong thing by ignoring all letters, so did not make any appeals.

    The story.

My child started a new job and parked the car on a car park nearby, after work there was a PCN. Colleagues at work told my child it's a scam throw away, so it was, and carry on parking there, my child did, gaining tickets every day. We have had lots of ' notice to keeper' letters from TESGB. They do seem to have contacted DVLA and got the owners details. Had lots of letters from 'ROXBURGHE' debt solutions and from 'UCS' and finally from 'GLADSTONES' solicitors. Now we have received a county court claim form from the county court business centre. The total bill is now £3617.66. Now we don't know what to do next. We have never replied to any of the letters. The court claim is genuine as I was worried and emailed the court, they replied to say it is real. Advice would be grateful.

If you could start a new thread of your own, any answers can easily be found.

You need some urgent guidance so I suggest you start your own thread as soon as possible- by clicking on the big blue button entitled "New Thread" on the title page of this forum. (Or Click Here) In the meantime please read the Newbies thread - Click here - so you understand the situation. There is a lot to read but you - and you son/daughter - would be well advised to read through it.

Have you/your son/daughter acknowledged the claim (assuming that it has come from the CCBC Northampton and provides a facility for you to log on online)? If not then you need to do so as soon as possible to give you the maximum time with which to either build a defence of start negotiations. Do not opt to enter a defence at this stage. Acknowledging the claim will give you 28 days from the date of issue in which you can get things going.

We have not recommended that anyone ignore such tickets here for well over 2 years.

  • Thankyou. I have opened a new thread and will read the newbies. We have not acknowledged the claim yet we have until 23/2 to do so.
  • "ParkingTicketAppeals changes companies

The web site parkingticketappeals org uk has apparently changed hands.

Yesterday, the company on the about page was Parking Ticket Appeals Limited, company number 08981061, incorporated 7/4/2014. The secretary is Ricky Gater and sole director Kiera Prince.

Today, the company on the about page is Parking Ticket Appeals Service Limited, company number 08994668, incorporated 14/4/2014. This company appears to have one shareholder, Ricky Gater, and one director Ricky Gater.

The Prankster contacted the new company to enquire about current customers of the old company, and the new company liability to pay the parking charge under the guarantee if their appeals fail. Ricky Gater told the Sunday Times that that company was processing 400 appeals a week, and as appeals can take 2-3 months, there may be up to 5000 active customers.

    Although not replying directly to The Prankster's questions, a spokeperson for the company stated;
"It should not be lost on yourself that liability as previously explains lies with the company and liability cannot be transferred to another company"
The Prankster does not consider this an appropriate duty of care to previous customers, and has therefore removed all links and recommendations from his website to the company.

    Happy Parking

    The Parking Prankster"
