    1) a) The Charge is not a contractual fee – it is a disguised [STRIKE]breach[/STRIKE] penalty
    4) The alleged contravention did not occur....????

Have you seen the photos taken of your car? If they are alleging 'Parked outside marked bay' (or something like that) and photos can't substantiate it, then it's under this heading you challenge it.

If you decide not to put anything in, then you'll obviously need to remove the heading from the bullet point list and the main appeals' paragraphs section. Don't forget you will have to re-number the bullets/paras following.

You've got the other main winning appeal points covered, so send it off via the POPLA website, ticking 3 of the 4 'reasons', obviously not the 'stolen vehicle' one.

the problem with having 2 threads on the same topic is why it gets confusing, the photos are in the other thread , which I believe is more relevant to this persons popla appeal, whereas this thread was about the incorrect popla codes CPM were providing

    https://forums.moneysavingexpert.com/discussion/5155382

there was no need for 2 threads, but because there is , confusion reigns as usual

it would have been better to bump the popla appeal thread IMHO, not this one

You're over thinking this big time.

    You've got your POPLA code.

Send an appeal. If you lease your car exclude anything about POFA keeper liability and just send a copy and paste template. Use mine if you need to.

As said before in another thread ironic coming from me but relax. UKCPM put almost zero effort into the whole thing. They wont even try to submit evidence or counter your POPLA appeal.

Redx, that is why I had asked Crabman to merge my two threads, long before you made your comment. I actually bumped both threads because since I had drafted my letter I hadn't seen any action, so I put it on the other thread about the code which was receiving attention.

I am not used to using forums so apologies once again for being an idiot. Can't keep saying I'm sorry.

Thanks for your help, unfortunately my car was parked slightly forward of the bay and their photo shows that, so I can't appeal on those grounds.

I will as you say, take that paragraph out and re number.

I'll try and relax, but I can't help stressing. Anyway, happy to send off what I have now. No not a lease car...
Your posts were a real help to me, found it useful to see other appeals to the same company winning. Thank you for sharing. :A

Yay - way to go! Pleased you've sorted this lot out. Glass or two tonight (it's the weekend!)? Now time to get on with rest of your life!

Please do us a favour and tell all your friends about the private car park 'management' charade, the business model of which is principally aimed at issuing penalties to motorists and relieving them of eye-watering amounts of money. As you now know, they can be seen off with help from the forum.

Use Facebook and Twitter to tell your friends, and ask them to pass on the message to their friends. The more people know, the more sense we can knock into this system.
