    have found out from Barclays he took £9.5k out. they don't seem to want to sort it, they want me to go to the Police to get a crime number then they can investigate.


    weird thing is it seems he notified them a week after my Dad died, then he waited nearly a year before emptying the account. why?

    It's not that Barclays don't want to sort it, to start an investigation they need that crime number. You may have to wait until you get letters of administration before the police will give you the crime number.

    As to why he waited, maybe he was giving you a chance to come forward?

    I know have LOA. I doubt he waited because of me. he said at the funeral he was going to get rid of his wife, give her a bit of money, and then have whatever girl he wanted in the house. nice guy.

    That is simply untrue. If the OP has the LOA then the bank is obliged to pay the full amount of any sole account balances at the date of death plus any interest due. It is up to the bank to report that they have been duped. The bank will have obtained an indemnity from whoever they paid. They my choose to just pay up rather suffer the adverse publicity if they report it to the police. No crime has been committed against the OP.

    still trudging on. Police useless so IPCC'ed them.

    8, The person must know or ought to know that he or she is a trespasser. The offence will not capture someone who enters the property in good faith reasonably believing they had permission to do so. This might arise, for example, where a bogus letting agent encouraged an unsuspecting tenant to occupy somebody else’s property. In such circumstances, however, it might be reasonable to expect the ‘tenant’ to provide evidence of a tenancy agreement or rent payments to show they had a reasonable belief that they were not a trespasser.


    also it says if convicted it carries a 6 month imprisonment and or fine potential. would they do this to him in this situation?
