To get such an order you would need to provide proof of ownership. I assume that would mean a copy of the LR entry in your name. In any case why would you not want to register the ownship.
just read on here someone else who was sorting an estate out and wanted to sell the property. they were advised on here it might cause complications if they registered it in there name and then sold immediately.0 -
What I am saying is that to get an eviction you would need to provide proof of ownership. By far the easiest way to do that is to register it in the name of the legal owner. The fact that a property has only recently been registered makes difference whatsoever.just read on here someone else who was sorting an estate out and wanted to sell the property. they were advised on here it might cause complications if they registered it in there name and then sold immediately.0 -
should be interesting to see his reaction once I register it and send the eviction notice. I wonder if he will refuse to sign for it?

p.s. I need my bed.0 -
With a High Court writ their bailiffs just turn up unannounced with the paperwork, evict the residents and change the locks. They get a short time to gather essential belongings. They are allowed to remove the rest at a later date under supervision of the bailiffs. Quick and effective.should be interesting to see his reaction once I register it and send the eviction notice. I see no reason why the eviction notice would not be granted to the "estate of dad" who would be the legal owner, with yourself as representative?
I would go over to the renting and buying forum and ask a few questions. If you've have not made a mistake, you've made nothing0 -

Realistically you don't have a chance unless they cooperate which they probably will not. You could just seize the contents and ask them to prove ownership but that would be time consuming and could be costly.on the note of personal belongings. how am I going to tweezer out my Dads stuff from the step brothers?0 -
It depends on what the High Court will accept as proof. The OP needs to remeber that the "squatters" are not likely to take the whole thing lying down. He should be prepared for the possibility a lengthy and expensive court case.I see no reason why the eviction notice would not be granted to the "estate of dad" who would be the legal owner, with yourself as representative?
