    ok got the register. my Dad is listed as the sole owner from the purchase date until present.


    how do I find out if there is a will? I tried the gov site and it doesn't show one.


    also before I dig an almighty hole, due to maybe 192 and the neighbour getting there wires crossed, and I find out hes still alive. is there a way to find out if he is in fact dead?

    The previous suggestion that the step son has just carried on living there hoping nobody would notice, may well be the correct one.

    Which probably means no one has gone to probate.That could mean there wasn't a will, or whoever has it has trashed because they didn't like what was in it. Or it's sitting in a solicitor's deed safe somewhere and they don't know he's dead.

    As things stand; as your father's next of kin, you can apply for a grant of letters of adminstration, and get the title for the bungalow transfered into your name. If there is a will floating around that says something different, that should at least bring it to light.

    But you may well need to speak to a proper lawyer.

    I cannot say if it is accurate but as I said earlier, it is not a website to check if a will existed, only probate applications. If you had a will that could be executed without probate then there will be no record on that site or anywhere else as a public record.

    Yes I agree get a copy of your father's death certificate. It should also state the name of the person notifying the death. If the step son notified the death it might confirm he was involved in the process. Either way you would need a copy to apply for Letters of Administration or Probate.

    Of course it is possible he is not dead but in a care home or living elsewhere, in which case maybe the step son is living there with his permission. It is also possible there is a Will that has left the house to the step son who has just not bothered to inform the land registry.

    Assuming you confirm he is dead I suggest you write to the step son stating that you know he has died and would like to know if there is a Will. Is it possible that the step son does not know how to contact you and could not find a Will so is just waiting for you to contact him.

  • thank you all. this has been a quite stressful few days, as although I did not have regular contact with my Dad, I still have memories as a child.


    I did a bit of lateral thinking and searched 2013 and 2011, and I have found a will for 2011 and a correct date of death. so I have applied for a copy of it.


    ive now received her will and it seems she left her estate to my Dad, or if he died earlier or didn't live 30 days past her death, to her step son.
  • ok big screw up. the will I pulled is for someone else who has my dads first middle and last name and died the year before, whats the chances?


    anyway ill try and get the death certificate.


    is there a way to find out if there is a family solicitor? I think if I contact the step son ill get the blunt end of a stick, as I would think his Mum probably poisoned any views he had of me. ive never met him.

    ok update. apparently he did die in 2012. how do I sort this out without spending large amounts of money?


    I looked at applying for probate and that came with a £215 fee.


    I don't want to start spending that sort of money if they suddenly pop up with a will.


    ive phoned most of the solicitors in the area where they lived before and after they moved, and nothing.

    Am a bit confused??

    Did you actually find her will?

    If so, a good chance that his will would be done by the same firm?

    tried that site, nothing, but my friend said his mum had a similar problem. she knew there was a will, but it took two applications to the main probate office before a will and probate was found. im wondering if this is the same problem.


    I have a copy of her will via the same gov site. I did phone firm she did that will through but apparently there is nothing stored for my father.


    today I phoned round all the firms near there old address, and some near there new address, nothing. it seems strange she did one but not him.
