    You're pretty much bombproof then from a Small Claims Court standpoint. Have a read about the cross-border situation. Yep, OK, here's a link!

    Also use the forum search facility, using the keyword 'jurisdiction' and that should bring up some other threads where there have been similar discussion. It will give you some peace of mind.

    Use the Forum Jump to get back to page one and just above the sticky threads, on the right, is a heading along a line, next to forum tools, called 'search this forum'. Put your key word(s) in and change the default search to 'show posts'.

    If you're feeling belligerent and you want, after doing some further reading and getting to understand this cross-border stuff, you could send a short and sweet 'appeal' to the IAS to the effect.
    The driver is based in Scotland. I suggest you uphold this appeal to avoid your tame PPC getting totally out of their depth. If your PPC wishes to pursue this further, please advise them to attempt the issue of MCOL County Court papers via the Northampton County Court central distribution unit. Please make sure they clearly state to the court they are attempting to pursue a resident of Scotland.

    If rejected you can pretty safely ignore anything further, although you may get bombarded by debt collector letters, which carry no weight whatsoever.

    Others may wish to comment on this while you are looking at further info on cross-border difficulties for PPCs.

    Thank you so very much for taking the time to post this and for making the effort to explain how the use the forum functions. It is much appreciated.

    As is the advice regarding responding and for the advice on ignoring debt collectors.

    I'm originally from south of the border and have only been in Scotland for 2 years. I was aware that the court system was different, as are the parking restrictions. I wasn't aware of the problem of jurisdiction though.

  • This morning I received a re-issue of the invoice this time addressed to me rather than the hire car company. I've re-issued the original claim and added the legal challenges to counter their rejection letter,which I will send to the IAS. I have also included a point about jurisdiction. I'll let you know how I got on.
