No, which is why the OP needs to get the messsage across soonly rather than too lately.

Unfortunately I had appealed to PE as soon as I received their PCN (I assumed it would be an open and shut case, foolishly). In hindsight I should have came to here first. So yes, I admit I haven't been too savvy. They have received an initial appeal (saying that I was only just over as I had visited the shop twice etc), and the 'template' discussed above. They will receive nothing else from me and I look forward to it, in time, being dispelled. Couple of letters are fine if the external envelope isn't too threatening. Can't remember if I provided PE with a tel# in my original online appeal but not interested if they call, will simply hang up.

Sorry for repeating some of my concerns and questioning some of the advice here, I do appreciate it. I also appreciate living and this taking place in Scotland, sounds like I couldn't ignore it as easily if based in England/Wales.

    Scotland (& NI) = Ignore

England and Wales = Do Not Ignore

Here is hoping that remains the case and things don't change to the 'english way' while my PCN remains open...

The chances of the Scots implementing a POFA equivalent is remote but not as remote as the chances of any such legislation being retrospective.

Seems to me that pazza is almost wishing this on himself!
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Out of curiosity what made you think that?

Since it is exactly the opposite of the reality.

Where have you been getting your information from?

Here. I'm not saying it can't be ignored or quashed in England/Wales. Im just saying that the process (ability to ignore, powers of chase) appears easier here in Scotland, or so it reads as per the advice available online.
