If Deal are the DC, how can they bring a case?
And what were the parking charges for?
They've been performing some pantomime about the "debt" being assigned. No-one believes it. It'll be interesting to see what the court makes of it.

They might do so, but the principal is the Co-op so a claim can be made against them.
According to The Prankster's Blog there is some confusion about who's name the contract is in as reference is made to "a third party, Creative, and that the Co-op's contract was with Creative rather than CEL, although this was a simplification".

Once CEL stared sueing hundreds and hundreds of legitimate Co-Op customers and the Co-Op washed their hands of it effectively hanging out the customers to dry. They knew full well what CEL were like and deserve no sympathy at all.
I'm not sure who I want to win this. Can they both lose?
I thought the Co-Op instructed CEL to drop the cases, but CEL basically told them to FRO and went ahead with them anyway, or was that a different retailer?
If you're dealing with a company as pig-ignorant as CEL who outright refuse to play ball regardless of the fact you are their client, there are limitations to what you can effectively do, no?0 -
You'd hope the Co-op has some membership of, or access to, a circle of major (and minor) retailers and will give them all chapter and verse on not only how CEL has acted here, but how any other PPC is also likely to follow suit (witness Sommerfield -v- ParkingEye).
When will they ever learn, when will they ever learn!
Lose customers, p/ss off staff, cause unknown grief, cost zillions in legal fees and potential cancellation charges. All so that a handful of rogue parkers (which no one here would condone) are chased off.

The Co-op acquired Somerfield in 2009 several years before the infamous Parking Eye v Somerfield case came to court. So it was in fact a wholly owned subsidiary of the Co-op that was sued by PE for breach of contract after PE were kicked out for overzealous parking enforcement. Regular readers will recall that the presiding judge found PE guilty of the tort of deceit i.e. what we non-lawyers call lying.
It seems astonishing that the Co-op should be so obtuse as to ignore the true nature & ethics of CEL after their experience with PE.0 -

They were also represented at that hearing by Mr Ritchie, and I am surprised he would want to represent them again after seeing their 'contractually agreed charge' arguments torn to shreds.
As for the Co-Op, I wrote to their CEO some time ago about the lessons they should have learned from the Somerfield debacle, but all I got in reply was a load of corporate bullcrap from some lackey, about how 'our customers have told us they can't always find a space, due to non-customerS taking up spaces".
So they bring in a PPC, and in the first two weeks ticket and discourage most rogue parkers, happy days. Except that the PPC wants to recoup the investment, so now they have to start finding other people to ticket.
And who are those other people? Customers and staff, of course. When will they ever learn?
