    so its not a popla letter, its a WRIGHT HASSELL letter rejecting the original popla appeal that was made to London Councils and deferred pending the BEAVIS case last year

    WH have rejected your appeal on behalf of the BPA , nothing to do with the old popla now , nor the new popla run by the Ombudsman Service
  • Whats my next course of action in this case then? I've done a bit of reading and there appears to be a lot of confusion about where the "3500" stands since Beavis lost and WH took over proceedings?

    there is no confusion at all

    WH are adjudicating those thousands of appeals on behalf of the BPA and will generally side with the operator

    you can make a complaint to the BPA and the DVLA and also to Nicola Mullaney if you have a case (same as the others who have had appeals rejected recently)

    It's a rejection because:
    * It's for £100 and Beavis says that's OK
    * Signage is apparently adequate and complies with BPA CoP
    * They have sufficient evidence of PPC having legal right to manage.

    Do Napier have your new address? If not then all correspondence will go to the address your vehicle was registered to at the time of the original event ... which means you may miss court papers etc. and end up with a default judgment.

    As mentioned, complain to the BPA and ISPA about the fact the POPLA wasn't handled correctly, and then complain to the SRA about WH's deliberate misrepresentation of the legal issues and conflict of interest (you believe they aren't acting impartially, and are going to be involved in any follow up legal action).

    Then you wait for Nappy to try court, and hopefully beat them and get your expenses back :)
  • Nappies haven't made any correspondence with my new address, but then 90% of their correspondence prior was via email.

    I'm sceptical about complaining to yet another body, I was of the impression that POPLA acted above the BPA?

    Unless you have notified N@ppy of your new address they will continue to use the one originally used for the initial PCN. You changing your address with the DVLA is irrelevant; there is no further updating to the PPC from the DVLA.
