  • Had an email from Napler the other day giving another 'relevant' court case. Appellant had overstayed by 2 hours in a free retail car park. I put my argument forward how this wasn't at all relevant and POPLA have said because they've recieved it they've now had to postpone their decision by at least 21 days. I'm not sure if this is good or bad :P

    I suspect that, in this case, Napier have an interest in the land. probably through a sister property company.

    One thing puzzles me OP, where did you park? You say that all the visitors' places were full, so I am assuming that you parked in someone else's space, in which case. where did they park?
    You never know how far you can go until you go too far.
  • None of the spaces are assigned in the indoor car park, and not every apartment has a car. There are many completely un-used spaces throughout the indoor car park, as opposed to 15/20 outside in the visitors car park

    The sign referenced in #22 does not have the correct bricks & mortar address for Napier Parking Ltd & as such is not capable of offering a valid contract for parking. If the entrance sign (which the OP hasn't linked to for some reason) is the same then the entire claim for damages for breach of contract is invalid as there never was a contract. The registered address for Napier Parking Ltd as per their website is in Milton Keynes not a PO Box in Hampshire http://www.napierparking.co.uk/contact-us/

    OP you need to contact POPLA immediately with this argument as it totally invalidates any claim.
  • I've already been through that bit with POPLA, the entrance sign is different based on the photo's they sent me, however check of street view images from august last year and september 2012 show that the terms were removed at some point between those two dates, and the image they sent matches that of the 2012 street view, with shops visible in the 2014 streetview not present in their 'evidence.' I have some pretty solid arguments against them, this latest court claim appears to be them clutching at straws :p I'm not really worried now, I'd be very surprised if POPLA don't help my case

    !!!!!!. Don't believe there is anything I can do at this point, POPLA have said they wont acknowledge any further communication. For what its worth, I have changed address twice since the original incident. Are Napier required to send another letter to me requesting payment?

    Check your credit file - wouldn't be surprised if they've got a default CCJ against you. If it's clear, stay under the radar but make sure any post from your old addresses WOULD Be sent to you, is that possible?!

    Or do you mean you have a letter from Wright Hassall acting as POPLA asking you to add any comments?
