Tenant removal timeframe ?

OK long story short

  • Chap i know is a tenant in a property
  • Due to vrs reasons hes not been paying the rent on this property for the last 6 or so months
  • He has been issued a S21 which expired 24th dec 2014 ( after 2 months notice ) due to not paying the rent
  • Its fair to say that the letting agent is professional considering whom owns the property ( id rather not say , BIG landowner) and the s21 is without fault and valid
  • He has lived in the property for the last 4 years without previous issue
  • The property being on the fringes of the letting agents area and had not been inspected since he moved in
  • The property is in a very poor state due to this chap abusing the property so there are holes in the walls plus the kitchen has been kicked to bits , the letting agents will not know about this but its worth mentioning

And now the questions

Given the s21 has concluded approx how long will he have before further court action will occur ? I appreciate this would be based on how quickly the letting agents seeks further action but are we looking at a week , month or half a year as a rough estimate based on likely experience ?

Approx how long will it be expected before hes finally kicked out ?

The reason to ask is he has 2 children both pre-school plus 2 dogs ( letting agents dont know about these either ) and as such will need to find a place to live .
I am doing my very best to guide the fool but he wont hear reason and seeks excuses . I would guess at some point a court order will turf him out the same day and then he will have the joy of many court appearances for ccj`s (the consequences of his actions toward the house ).
He is deluded into thinking he will retain both references given he believes its illegal to offer a bad reference ( slander then ok but not illegal if its true but once again he wont listen ) plus he thinks he will get his deposit returned and can be used in the next residence regardless of the willfull damage plus lack of rent being paid .
He firmly believes he has 3-12 months before being removed where i keep pointing out the high court can have him out this week if they choose to walk this path so he needs to get himself sorted asap.

Be under no illusion i dont condone his actions but hope that a little more info will help him understand the consequences of his actions and not dig an even deeper hole for himself.

    6-10 weeks is considered average- depending on how busy the court is.

    He's hping to learn a very blunt lesson in due course

    Ah , children im afraid :(,,,,, they of course dont deserve to be in the middle of all this so im trying to guide as best as possible a course of action for him to take . Sad to say hes very thick headed and wont hear a voice of reason .

    He simply fails to get a grasp that unless he sorts himself out very very soon a bailiff will be knocking on his door to remove him , its not a may , or might it is going to happen . Just tonight i explained i had seen yesterdays ``wont pay we`ll take it away`` pointing out how a chap sat in his car with wife and 2 small children in the back in tears , destitute , but he wont get the analogy into his thick skull

Then theres the small matter of the 7 defaults hes made on credit in the last month meaning he isnt likely to pass a credit check now which doubles up the its not going to happen chances . Then theres the issue of his furniture wont fit in any other house than what he has now plus he wants a ``decent `` sized house due to some sort of snobbery .What can you really say or do ???? ive nagged , moaned and no matter what i say he just isnt getting it that he isnt doing himself any favours whatsoever .:wall:

    so he is going to end up in emergency accommodation .I would guess the dogs will have to go .

    not to mention that the current landlord will continue to pursue him for the arrears.......

    Would he get help from the council though since he's intentiakky made himself homeless by not paying his rent? I know there are children involved but perhaps only the children will be found beds. I really don't know.

    He's living in cloud cuckoo land at the moment which wouldn't be so bad if it was just him but it's not.

    The defaults might not be such a big deal unless he's had any CCJs awarded against him depending on how thorough the credit check on the next place is. It's whether or not his current LL gives him an honest reference that will be a problem. Then again he might get lucky and find one of those daft LL who don't bother referencing people.

    The replies ignore the position of the landlord as the question is not from the landlord. Landlord is mentioned as being a "BIG landowner", not the OP.

    Unfortunately for these children involved seems they will take the brunt of this guy learning the lesson he is about to get. Hopefully they will have some aunts/uncles/grandparents nearby who will be able to take them in when the brown stuff hits the fan?
