Lol this is getting absolutely ridiculous now. Never heard so much tosh in my life. All I did was parked my car in the bay correctly.

Yes, and after you had correctly parked, someone incorrectly opened a car door by not checking that it was safe to do so.

Next time I will get gull-wing doors and a mind control chip to install in the passenger brain so I have total control of the passenger lol

You don't need total control of your passengers as long as you realise that they are passengers in your vehicle which is insured in your name hence you are responsible for any actions that they do which impact on that insurance.
You don't need to install a mind control chip. A common sense chip will suffice.

To be fair to him he probably didn't.

Well, even if he didn't open the door himself, he was in control of the car and the law says "No person shall open, or cause or permit to be opened, any door of a vehicle on a road so as to injure or endanger any person."

Well as you're being pedantic how did he cause or permit?

The offence was complete when the passenger opened it.

There's 3.5m driving width as you say. According to Hyundai Santa Fe specs shown here:

    http://www.parkers.co.uk/cars/reviews/facts-and-figures/hyundai/santa-fe/estate-2001/24367/

Its width is 1.82m. Ok lets do the math. 3.5 - 1.82= 1.68metres.

No way my Peugeot 206 door is 1.68m width or longer even when fully opened.

It isn't us you need to convince, it's your insurance company. And your passenger is liable, so they (or your insurance company) should end up paying out.

Yes, say that to the insurance company.

Do let us all know when the insurance company puts you at fault, by simply not returning to the thread. ;)

Should the driver of the passing car take extra care and left a door width apart space in a area like this? Driver should have known passengers in a area like this exit vehicles and should have taken more care plus I know the driver could have left a door width apart space.

    What are your opinions?
But before posting, please note that I only want opinions that say that myself and my passenger did nothing wrong.
If you have a different opinion, kindly keep it to yourself.

Was your passenger Disabled Rights For Me?
Just get them to wave their blue badge.
I'm sure the amount of disabilities combined you 2 have, no court in the land will find you accountable for any accident.

Or the court will decide that they aren't safe to drive, and revoke their licence

If you are all blaming me then it looks like its my fault for not installing Gull-Wing doors on my Peugeot 206.

I will go to the station tomorrow and will see any safety warning signs that will indicate whether onus is on driver or passenger.

You want me to take responsibility for something out of my control. Lets say you sailing your boat and one of your passengers committed suicide by jumping off. You as the captain will accept murder charge?

I seen cars go pass parked cars with passenger doors fully open that day with no incident. Im sure the designers that built this place thought about this. If passenger doors are opening and cars cant drive pass because of this then there would be huge delays for cars there due to a design flaw.

All I did was parked correctly in the bay

    Don't make me laugh.

Your passenger is responsible, like it or not.
They were traveling in your vehicle that you were in charge of. So it's the insurance that covers your vehicle that pays out.

If your passenger isn't capable of understanding that you need to make sure the coast is clear before opening a door, then you as the person in charge of the vehicle should have made sure the coast was clear before part of your vehicle was opened into the side of another vehicle.

So I come back today and this muppet is still refusing to face the truth.
YOU are liable, YOU are at fault.

DUTR: when I said "..choice of repair..." I should have said that means leaving out the Insurance companies and making a Gentleman's Agreement. Naturally, that would take TWO reasonably intelligent people.

    Silly of me, I know.
I think this job really needs
    a much bigger hammer.
