    Because they chose to transport 'idiots', and didn't take control of the situation to make sure that the 'idiots' they transport can't cause damage to other vehicles through act or omission.

    If you handbrake fails through no fault of your own, and the vehicle rolls down a hill causing loss to a third party, then your insurance will pay out to that third party with no negligence by the policyholder.

    And by saying that, you fully demonstrate your complete and utter lack of understanding of the subject.

    It's a tricky one, but for me, it's your fault. Yes, the driver of the car may have been going too fast, yes, he might have been too close, but a passenger should always take care exiting a vehicle. He/she are lucky it's your door and not their body and that, for me, is why the onus is on the passenger to check and check twice to make sure it's safe.

    The only time the situation would be reversed is if the door had been opened for any period of time. Say, the passenger opens the door, gets out, and then walks round to the boot and while this is happening, someone takes the door off. Then, for me, the driver of the car has simply hit a stationary vehicle, their fault.

    Just saw this thread OP, when did you change the picture? I can see a black saloon stopped beside a wide pedestrian area on the right and in this pic. a space on the left that two buses could happily pass through, no tight squeeze there.
    Anyway, as were now in the days of cheap and cheerful car insurance, both companies will declare a 50:50, you for not having control of people covered by your insurance, and the other for not being able to stop. (Think of the children etc., etc.)
