    Passenger is in early 60's can still see and hear but obviously doesn't have sharp senses as us young ones. I believe if I went over to assist passenger getting out then I would have been killed by the speed of the other driver. Passenger doesn't need assistance as passenger not disabled.

    If it were going that fast why didn't you warn your passenger?

    Surely in that enclosed area you heard the engine.

    A engine that's doing over 5mph is not loud. Even a Ferrari is not loud at 6, 7, 8 9 and even 10mph.


    Like I said I am not obliged to warn unless passenger is blind, disabled or a child.

    So you believe you would have been killed by a car neither you nor your passenger had seen that was travelling at a speed you could not know because you hadn't seen it approaching.

    No word yet on the cost of repairs to the Santa Fe yet then?

    Are you going to claim off his insurance for the damage to your door?

    If you did nothing wrong and he hit your door - then I'd be claiming he was responsible.

    Someone must be at fault here - and if it wasn't you or your passenger - then the passing car must be - logic innit?

    The adverts tell us a child survives if hit at 20. ;)

    That 5mph sign isn't the speed limit.

    Ask yourselves why did that train station put up 5mph warning signs in a drop and go area?

    Good question, it's on a temporary fence if the construction workers take the fence away what will the speed limit be then?

    If you insist in going down the lines of he was speeding you need to get your facts right.

    Is that sign complient?
    Where does the 5mph limit start? The sign looks too small to be the start of the limit and if it is the offside one is missing.
    Have you obtained a copy of the tro making it a 5mph limit?
    Who are you using as your expert to prove the speed?

    I cannot believe this argument is still going on. Like it or not, OP is going to have to cough up, no matter what excuses or irrelevant arguments about children on the roads or blind passengers (that were not even in the vehicle), that you can come up with.

    Save the irrelevant scenarios for the insurance company.
