If I were you, I would pop into the police station and explain what's happened. It might help, it might not. But it can't do any harm.

Huh?
I'd understand checking court records and birth marriages and deaths records, but police?
I doubt they'd be able to say anything, or even be remotely interested.0 -

They might not be able to say anything to OP. But they might let a relative know (e.g., if he's in prison), and relatives can then arrange for items to be collected."Real knowledge is to know the extent of one's ignorance" - Confucius0 -

Sorry I normally agree with u, but not in this case.
At best it's a missing person enquiry.
But the property still can't be moved. The tenancy still stands.
If tenant is dead, then his estate needs to be resolved. Can't just let anyone take the stuff.
He could easily be away with work.
Perhaps this is a base for him and home is elsewhere?
I would check death notices and court listings. But if both of those draw a blank, I'd just continue with s21
Edit: will find the case but prisoner sued his LL successfully for illegal eviction. So best to follow procedure0 -
As a side thought, isn't it normal for tenancy agreements to have a clause about being in the property for a certain amount of time?
I have to tell my landlord (and get permission? sorry bit blurry on the details as it hasn't been relevant for me yet) if I am going to be away for more than two weeks.0 -

Yes common feature ( ur not asking for permission, you're notifying them ). Mostly to do with insurance.
Certainly it could be raised as a breach of tenancy, but likely to take as long as s21 to get to court. Where s21 is guaranteed.0 -

Maybe nothing happens when OP goes to police. Maybe some additional information comes to light on which OP can act. It won't take long."Real knowledge is to know the extent of one's ignorance" - Confucius0 -

Yes, this is usually written in for insurance reasons. And not wanting the place flooded in a big freeze. For periods of absence this long, insurance companies often required water off, tanks drained and pipes flushed with air.
OP should check insurance position."Real knowledge is to know the extent of one's ignorance" - Confucius0 -

His tenancy expires in 2 days and I cant locate him-his phone is disconnected and he doesnt work at the place i knew him from anymore.I've tried facebook but no luck.
Question is this, what do I do now?
He hasnt done anything wrong so i guess I cant remove his stuff, and I presume I cant readvertise it?
I cant issue an eviction notice as he's never lived there.I went last night and let myself in-I had to push the mail away from the door to get past!
Any ideas folks?
Why did you enter?I am a LandLord,(under review) so there!:p0
