According to Parking Prankster's latest blog, Excel have jumped ship from the BPA Ltd to IPC. :-

At this rate the BPA Ltd will only have Parking Eye and Trev's outfit as members.

Sign still has the magic words '...... breaching these terms and conditions ......'

So a continuing need to define their GPEOL - whatever the IPC IAS might make of it. :)
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Looking at the sign on the PP site would, to me at least, seem to indicate that £15 charge is more likely to be the cost of the IAS appeal. If you appeal to Excel, and then the IPC 'independant' (sic) appeal service then it incurs a £15 cost to Excel when they win.

If the landowner subsequently cancels the PCN (which Excel would no doubt charge them for anyway) then Excel would be out of pocket by £15 and so they have passed that back onto the victim.

Update - I think we can now safely drop the word "seem" from the thread title.

The IPC website AOS listing now clearly shows that as of 1 January 2015 Excel Parking Services Ltd are members. Not entirely a surprise.

Bye bye to SRS's seat on the board or has he bought shares in IPC Ltd? I think we should be told. Or is Karen's horse going to have to go - along with the yacht?

Pleasing to see that Excel - forever behind the curve - can't update their website which continues to show that it is a BPA AOS member.
My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com

I'm sure the appeals service doesn't have any dependants, so your "sic" is a little misplaced. Or did you mean "independent"?

It's a little jibe at the spelling on Excel's website: "Independant Consultancy" is one of the services they claim to offer!

Somewhat disturbing, though, that the Protection of Freedoms Act is now in play without the checks and balances that the government insisted were in place, i.e. an independent appeals service. The IPC is no such thing, which an increasing number of (major) PPCs are now members of. Of course the DVLA in their negligent way are allowing continued illegal activities by the PPCs in their own criminal behaviour (by which I mean continuing breaches of the DPA).

Yes but this short-termism will ultimately be their downfall. I am increasingly of the opinion that, as suggested recently by The Deep, people should be encouraged to appeal to the IAS even though we know they will probably lose. The IAS figures on appeals upheld against appeals rejected will be so grossly different to PoPLA's that ultimately the minister will be unable to ignore it.

Furthermore everyone who gets a stupidly-biased, unprofessional and anonymous appeal rejection from the IAS needs to send it to DVLA, their MP, and Robert Goodwill.

Also, given the involvement of solicitors, it should also be the subject of a complaint to the SRA regarding breaches of various of their principles, specifically:

    "You must:

    1. uphold the rule of law and the proper administration of justice,
    2. act with integrity,
    3. not allow your independence to be compromised,

    6. behave in a way that maintains the trust the public places in you and in the provision of legal services"

    Just remember.
The Minister has ignored everything so far, so do you really think anything will change?
Allowing IPC / IAS in the first place tells you something

Am I missing something - I thought POFA required any appeal system to be free to the motorist so how do Excel get away suggesting they will charge £15 for any cancellation ?
