    At work, we have a tree in the car park, an oak tree with one large dead branch hanging over one of the parking spaces. Nobody noticed this "danger" until I pointed it out.

    A land owner can only be held responsible if they knew the problem existed and had chance to rectify it, but then the same person notified them and then got injured by it, they could claim that the individual should have acted accordingly.

  • Where do you live? I find it hard to believe the weather has been cold enough to form an inch think slab of ice, which is what would be needed to "cave in your roof".


    The last couple of days have been well above freezing across the whole of the UK.

  • Anyway, playing devils advocaat (seasonal spelling), how would you have reacted had you been walking along that road with your young children and a large lump of ice fell onto them severely injuring them or possibly worse?
    Would you still be taking the same stance on the "NOBODIES FAULT" scenario?

    I would imagine it would be practically impossible stopping nature take its course and ice forming and if the buildings owner were to put a sign up saying " warning, don't park here, risk of falling ice" they would be going some way to excepting liability.

    Owners/occupiers have a duty of care.

    If they know or have been informed of a potential hazard and do not do anything about it then they may end up in hot water next time something happens.

    Considering the described damage to the car, it could have killed anyone walking under the ice when it fell.
  • I disagree. If we are looking up to people's roofs, we are not looking down and then we might fall over and hurt ourselves.

  • The post was on there yesterday so what the wheather was like last night is irrelacent.
