I have to admit that this forum is more than great. I (and too many) learn new things every day from this form because of the sincere dedicated members. However, this does not eliminate the fact that the good members are mixed with few narrow minded who are holding their hidden agenda on their shoulders all the time. Who cares?

The elderly of course make excellent landlords as they forget they've already collected the rent, so collect it at least 3 times each month.0 -

If it was me, and I had decided to serve him notice, I wouldn't even have bothered mentioning the kitchen cupboards. If it was him that did it, he would have figured out why he got notice, and his guilty conscience probably would have forced him to mention it.

I am in serious stage in processing the purchase of my future house in Harborne Birmingham. I certainly have learned every day from this forum. I am grateful to the respected members who are committed to "help and assit others".I will search for the relevant information from now on. Quite few members here are committed to "the disturbance and annoying of others". Those have got plenty of time in their hands. Probably they are unemployed/ burden on tax payers/ jealous of those who work hard for the sweat money. My gut feelings never let me down. I believe that the OP and his co-authors are from those I described above, "the burden". Again to those respected members, I am grateful. Thank you.0 -

Yes, he responded repeating the same things really - he believes it's an illegal eviction and that he doesn't accept the notice, but will pay his rent on Sunday.
I sent one back saying (with names changed):
Steve,
My suggestion to you is that when you return this weekend, have a read of your Contract, in particular Section 8. This Section covers my rights as a Landlord to give any lodger a month's notice to leave.
If, after reading your Contract, you have any more questions, I can then sit down with you amicably on Sunday afternoon and answer these for you.
Obviously you're well within your rights to discuss the matter with solicitors if you so wish.

I know that I'm absolutely within my rights, it's just a hassle. I've also got a new lodger moving in on Monday into the other room, so I'm hoping to make things amicable so that she doesn't feel uncomfortable (given that this chap will still be here for a few weeks yet)
In hindsight, I would do a few things differently:
1. I wouldn't make the notice period as long as a month
2. When he told me before Christmas that he would be looking to move, in hindsight, I'd have been better making him aware then that I might decide to give him his month's notice at some point, rather than dropping it on him out the blue via email.
3. In hindsight, I should have spoken to him at the time about the little things which I chose to ignore (the swapping around of the kitchen drawers, the taking down of the cleaning rota etc, as well as 1 or 2 other little things). I feel that because I let these minor things go unchallenged, he's started to treat the house as if it was his own, rather than somebody else's.

In his email he sounds like 'one of those people' who know their rights and when they don't, they then check their rights to then further defend themselves.
It appears he really is a bit slow, because 30 seconds of Google searching can show him his legal standing as an excluded occupier and that when you say 'get out' he has to go, as per any contract you two entered into, which in this case you have honored.
I am interested in this because in a few months time i will be purchasing a larger property and having two lodgers live with me - your pain and trouble are my learning curve!
I will continue to watch how you resolve this and thank you for the update.0
